Department of Justice says Boeing breached 2021 agreement that shielded it from criminal charges over 737 Max crashes

Boeing violated a 2021 settlement that protected it from criminal charges tied to the fatal 737 Max crashes, opening the company up to potential U.S. prosecution, the Department of Justice said Tuesday.

Federal prosecutors said in a court filing in Texas they are still determining “how it will proceed in this matter” and that Boeing will have 30 days to respond.

In January 2021, Boeing agreed to pay $2.5 billion to settle a conspiracy charge with the Justice Department. After a roughly two-year probe, the DOJ accused the company of concealing information about its Max plane that had been involved in two crashes that claimed the lives of all 346 people on board.

Boeing had admitted that two of its 737 Max technical pilots “deceived” the Federal Aviation Administration about the capabilities of a flight-control system on the planes that was later implicated in the two crashes, the Justice Department said at the time.

Looks like a blatant fund raising attempt to me.

Right now we can only suspect, we will know it was fund raising when the issue abruptly goes away...

My wife and I spent 2 hours yesterday morning on a Boeing 737 Max 8 flying from Seattle to Denver. Nothing fell off. Good flight!

The airplane manufacturer broke the agreement by “failing to design, implement, and enforce a compliance and ethics program to prevent and detect violations of the U.S. fraud laws throughout its operations,” the DOJ said.

All of this Boeing crap can be traced back to the McDonnell Douglas merger. Prior to the merger, Boeing's managerial cadre were engineers and decisions were engineering-based that took the long view.

Post merger, many M-D managers were kept on at Boeing, and gradually changed the corporate culture at Boeing from engineering-based to shareholder-value based. Decisions started being made with an aim to increase stock values and performance in the next quarter, instead of the decades-long view of what it takes to bring a new aircraft to market.

Ironically, it was this very same short-term thinking that doomed McDonnell Douglas in the first place and required the merger with Boeing to keep the M-D Defense division (makers of the F-15, F/A-18, etc.) alive.

Boeing needs to purge it's C-suite of all M-D alumni and protogees of M-D executives, and return to a culture of engineering-based decision making.

Wouldn’t the world be safer if instead of paying a 2.5 Billion dollar fine to the government, they were ordered to set aside 2.5 Billion dollars to ensure the safety of their airplanes and improve the qualifications of its mechanics?
