Texas Governor Greg Abbott issued a full pardon and restoration of rights for Daniel Perry, the former Army sergeant who was found guilty of murder for the fatal shooting of Garrett Foster during a 2020 Black Lives Matter protest while Perry was an Uber driver.
"The Texas Board of Pardons and Paroles conducted an exhaustive review of U.S. Army Sergeant Daniel Perry’s personal history and the facts surrounding the July 2020 incident and recommended a Full Pardon and Restoration of Full Civil Rights of Citizenship," said Abbott in a statement.
"Among the voluminous files reviewed by the Board, they considered information provided by the Travis County District Attorney, the full investigative report on Daniel Perry, plus a review of all the testimony provided at trial. Texas has one of the strongest ‘Stand Your Ground’ laws of self-defense that cannot be nullified by a jury or a progressive District Attorney. I thank the Board for its thorough investigation, and I approve their pardon recommendation."

Hmmm - I stand corrected. I haven’t done a felony case in years and when I was in law school it didn’t apply.

The BLM protestors beat on the car with objects, kicked it slammed it with their hands. Perry and his car never presented a threat to the protestors.
Garrett Foster then approached Perry's driver side door with his AK47 style rifle in a low ready position, and motioned for him to roll down the window. Perry had a revolver for self defense.
Perry says he saw Foster start to raise the rifle toward him. No one else testified they saw this motion, but it was a chaotic situation, and Perry, quite naturally, would have been laser focused on the rifle's muzzle.
Perry shot Foster multiple times and Foster went down, the crowd scattered, allowing Perry a way to escape the situation. As Perry escaped, another protestor fired at Foster three times. The shots were all within a few seconds.
Within a minute, Perry pulled over and called the police.

I’m glad that he was pardoned. It seems like he was in fear for his life and responded correctly.
I won’t celebrate Daniel Perry because he’s a groomer of a 16 year-old, but because they found that evidence when investigating him for a crime he was wrongly convicted for, he shouldn’t be charged with sexual messages with an underage girl.
But I don’t have to like him to celebrate Gov. Abbott doing the right thing here.

one day, when the Republic is ready to be fixed, there will need to be some updates to the Bill of Rights and one of them will be the right to bear AND use arms to protect yourself AND your property.
