Citing a violation of First Amendment and Fifth Amendment rights, cable news outlet CNN has filed a lawsuit against the Trump administration, seeking the permanent return of Jim s press credentials.
CNN is claiming that while it happened to Acosta, it could have happened to anyone.
CNN Post : "CNN filed a lawsuit against the Trump Administration this morning in DC District Court. It demands the return of the White House credentials of CNNs Chief White House correspondent, Jim Acosta. The wrongful revocation of these credentials violates CNN and Acostas First Amendment rights of freedom of the press, and their Fifth Amendment rights to due process. We have asked this court for an immediate restraining order requiring the pass be returned to Jim, and will seek permanent relief as part of this process. While the suit is specific to CNN and Acosta, this could have happened to anyone. If left unchallenged, the actions of the White House would create a dangerous chilling effect for any journalist who covers our elected officials."
CNN Tweet :"CNN Communications✔@CNNPR This morning, CNN filed a lawsuit against @realDonaldTrump and top aides. The White House has violated CNN and @Acosta's First Amendment rights of freedom of the press and Fifth Amendment rights to due process. Complaint: https://cnn.it/2OEx8L1 5,787 9:18 AM - Nov 13, 2018"
I really disagree with the claims.
Well several reporters have taken to open hostility with this administration (rightly or wrongly, depending on your point of view), the fact is that Acosta was the biggest, loudest, and most obnoxious voice in the room, often to the point of distraction.
There is nothing in the First Amendment that guarantees the right to a hard pass from the White House to a reporter, and there is nothing from the White House indicating (so far) that they wouldnt allow another CNN reporter in. Likewise, Acosta is not being charged with a crime, so I dont exactly see how this is a Fifth Amendment issue. The press pass is not his property, it is a privilege granted by the White House.
The whole issue is stupid. Acosta has done more harm to press pool journalism than he ever did good. You can debate the value of a White House press pool for days, but its very hard to argue that hes doing anyone other than himself any favors when he openly combats the President, Press Secretary, and other White House officials.
How many journalists have missed an opportunity to question the White House because Acosta has refused to give up the spotlight? How many times must we endure his holier-than-thou approach to White House journalism? How many news cycles become about him and Trumps war with the press instead of the actual news of the day?
Lest we forget, the day Acosta lost his press credentials was the day Jeff Sessions was forced to resign. Which issue are we still talking about right now?
This latest stunt by CNN only further fuels Trumps base against them, and makes it so much harder to take them seriously in the Trump era.
On this basis, I suppose we ALL could sue POTUS over being allowed into the press briefings, because “freedom of speech”.
Acosta is pushing his luck here; my feeling was that he should have been arrested and charged with assault and/or escorted out by armed SS agents.
He’s compromised.
He “auto-recused” CNN
Replace CNN with Comedy Central. They provide more accurate news reporting.
Then next, a judge will decide how often Trump has to have press conferences and who he needs to call upon and in what order. This is just stupid.
The irony is if they had done nothing it would have blown over in a week. A Judge may take several years...
No laws restricting “freedom of the press” are being passed, or even considered.
Acosta, et al CNN, can feel free to write and/or report whatever they like, under “freedom of the press”.
But, the Constitution does not state that the press has “freedom of the White House”.
CNN should, by rights, be admonishing Acosta for his rude and disrespectful treatment of the President, and especially the assault on the female intern.
Trump should reply with, “The pass for Acosta is no longer “temporarily cancelled”, it is now Permanently cancelled.
CNN is free to send another reporter in his stead, so long as they behave with the decorum and professionalism required in such a setting.
That’s why the whole WH Briefing thing needs to be ended!
The media insists on behaving like spoiled children, tell them the “playground” privileges are suspended until further notice. End the WH Press Briefings!
There is no Constitutional requirement to do these in the current way they are done. The current method is hopelessly out of date anyway. It just encourages “Look-At-Me” prima donna behavior!
The method that should now be done is the following send out a notice to all current certified WH Press Clowns a link where they can upload questions on the “Issues of the Day (actually any topic!)”. “Issues of the day” will have the highest priority in being answered quickly. Also put said link on the WH Web site now anyone can play “WH Reporter”, announce that the first 100 “Issues-of-the-Day” questions will be answered. (Duplicate questions will be combined/discarded!). These answers will be available in the WH Press Room on DVDs with a paper summary available for pick up by the “Press Corps”. (They will also be downloadable from the WH web site.) Other questions will be answered in due time and posted on the WH web page and also available for anyone to download. The “Press Corps” can then take this and scream, whine, cry to their hearts content on network TV shows about the answers. Maybe someone will actually watch!
Trump can then buy time on the networks for “FDR style Fireside Chats” to get out whatever information he wants to get out. The “newsies” can groan & moan about that on the Rat rebuttable or their own news shows. Again maybe someone will watch! Also do similar shows and put them on youtube, etc. Remember the up & coming new voters relay less & less on TV, the Internet is their medium to pick up information. Trump needs to get in there and exploit that! But the current WH Press Briefings, that’s last weeks stale fish, get rid of them!
1st Amendment grants “The Press” NO right to special treatment and special access. Your lawsuit is a clown show move by a clown show network stuck in last place because of their complete lack of any journalistic ethics or integrity.
Of course, they will find a tame moron Judge to rule for them.
Judge Nappy is well past his best by date. he need to retire. He has lost all intellectually honesty and rational objectivity when it comes to Trump
True, but they are judge shopping in the dc court.
Nappy is always wrong lately.....he has joined the pond drain
Absolutely correct. The WH doesn't actually need to do press briefings. As to this Acosta idiot; he is very rude, not only to the POTUS, but, also to his fellow journalists who also would like to ask a question; but, this guy hogs the mic and refuses to ask his one question with one follow-up and then sit down.
He should have his press pass revoked just for doing the back and forth with the intern over the mic; acting like a toddler that doesn't want to share a toy. It was ridiculous.
This lawsuit should be thrown out as untruthful in the charge.
Acosta’s White House PRESS PASS was not revoked. His access card allowing him in the building was “frozen”. He can write and/or report all he wants. He just cannot do it from the White House. His First Amendment rights are intact.
CNN is welcome.
Not the creep who manhandled a young female intern.
MERITLESS.
The White House, above all, is the Presidents home. Guests (press) should show appropriate manners. Getting into a verbal argument with the President during a press conference is not good or appropriate manners.
More showboating by the pathetic CNN and their LEGENDARY low ratings.
But Little Jimmy PeePee Pants is probably soiling himself 24/7, he knows that with out his White House press pass, his career is OVER, baby! LOLOLOL!!
Helen Thomas had her press pass revoked by Ari Fleischer because she was such a nasty rude old hag and was very disruptive. It’s the not first nor last time something like this has happnened.
There is no “right” to a White House press pass for someone who has a long track record of rude and disruptive behavior during the press conferences. CNN can assign another reporter, but if that reporter is equally rude and disruptive, that person’s pass can also be taken away.
