Dallas Police Steal* $100,000 from Woman at Love Field
D Magazine ^ | 12/8/2021 | Peter Simek

Posted on 12/08/2021 2:31:37 PM PST by simpson96

Two local TV news outlets, WFAA and CBS11, picked up a story this week that was first reported on the Dallas Police Department’s Facebook page. On the surface, it reads like a feel-good story: On December 2, an adorable K9 named Ballentine identified a piece of carry-on luggage at Dallas Love Field Airport that contained $100,000 in cash. Police seized the money and posted a photo of the dog with stacks of cash laid out on a table. Good boy. Case closed. But not so fast.

According to the reports, the money belonged to a 25-year-old woman from Chicago, who was neither arrested nor charged with a crime after her luggage was seized by police. So why did the police take the money? Well, according to Texas law, police don’t need a reason to take your property so long as they believe it either has been part of a crime or they believe it will be involved in a crime. That grants law enforcement sweeping powers to basically seize any property they believe is suspicious, even if they don’t have much evidence. The fact that the K9 identified the bag is, in and of itself, not evidence; 90 percent of cash in circulation has been shown to have trace amounts of cocaine.(snip)

Civil forfeiture laws allow law enforcement to seize property without due process.

In Dallas, they call this a “revenue enhancement” program.

Drug runner.

All she needs to do is come up with a reasonable explanation as to where the money came from and where it was going. Then she can have it back.

People have civil redress in these situations via the federal courts. If it were my 100K you can bet your butt I would get it back.

HOWEVER, a 25 year old, female, going to Chicago (bang, bang), flying out of Love Field with 100,000 smackaroonies?

It's probably drug money and she's probably soon going to wind up in a shallow grave for losing it.

While cases like this make the news the average amount of cash seized in Civil Asset Forfeiture is six hundred dollars.

That is a six followed by two zeros.

Basically if you come to the attention of the police for any reason they can take any cash you have on you and you have to prove you got that cash legally.

Most people do not bother because they know that it will cost more to get the money back then just to let the thief... oh sorry... police take it.

CFA should be outlawed.

Normally, I don’t travel with large amounts of cash. I have, done so, and it was in banded stacks of $100 bills at $10K each that I had the bank deliver at my request
.

Not $100K in 5’s, 10’s, 20’s, 50’s and 100’s in used bills

You fight and 100k in legal bills piles up pretty quickly.

And what are you going to pay those legal bills with if you don't win?

Remember you have to PROVE THE MONEY INNOCENT.

That proves you are money laundering.

Wave bye bye to your cash now.

The highway that runs from Shreveport back towards Houston is infamous for the law pulling over “speeders” and finding they have been to the Casino, the car is searched. Cash is confiscated due to this same law.

Civil forfeiture laws allow law enforcement to seize property without due process. Which violates The Constitution (illegal search and seizure).

This was probably "bad money" but we do not know. If they can do this to this individual they can do it to you and this has been done.

I myself have carried tens of thousands of dollars in the Middle East for a very legitimate business. In Dubai they like cash and or certified bank drafts. I was simply moving tons of produce from Dubai to our warehouse in Oman. This was just the way it was done. It was all normal and legal.

Civil Forfeiture is a legal sham. Always has been.

And blindingly Unconstitutional. Why SCOTUS hasn't said so by now boggles the mind.

This is just plain theft. I support the blue but not shenanigans like this. Wait for her to commit the crime with the money first. This isn’t Minority Report.

That’s why you go on contingency. Ambulance chasers (oops, “Plaintiff’s Bar Attorneys” will salivate for a lot less than a $100k pot of gold.
