The Sheriff of Martin County Florida says U.S. Immigration and Customs Enforcement’s (ICE) is forcing him to release a dangerous illegal alien rapist from the county jail.
Juan Jose-Sebastian, 26, an illegal immigrant from Guatemala, was arrested in Martin County for driving without a license. (Update: After this story went viral, ICE authorized local law enforcement to locate and re-arrest the fugitive from justice).
Jose-Sebastian “will soon walk out of the Martin County Jail a free man, even though he has a warrant out of Washington County, Oregon for three counts of rape and sexual abuse,” the Martin County Sheriff’s Office wrote in a Facebook post Friday afternoon.
Martin County Sheriff William Snyder reportedly learned this afternoon that U.S. Immigration and Customs Enforcement’s (ICE) “will not take custody of the undocumented Guatemalan immigrant and Washington County Oregon will not extradite from Florida.”
As a result, the wanted rapist will be released into our community today. There is no legal way for the Sheriffs Office to continue holding Jose – Sebastian, as he completed his sentence for the charge of driving without a valid license.
Update:
Jose-Sebastian was released late Friday and now walks free.
Sheriff Snyder told CBS 12News that he’s “had enough.”
“We are being pushed and hammered by the level of undocumented immigrants that were housing and our jail. Today is a classic example of what’s going on,” Snyder said. “People ask me all the time, what can be done? The answer is this. I can’t do it. There are no local laws that empower me to do anything about illegal immigration.”
This year alone, the Martin County Sheriff’s Office (MCSO) has cited 140 people for driving without a license, more than 30 of them are currently waiting behind bars for immigration.
The most recent arrest was on Thursday when police arrested Jannier Alexander Pina Barboza, 26, for allegedly going over 70 mph in a 45 mph zone, past a group of kids waiting for the school bus.
But it gets worse, Snyder said.
“We have four undocumented immigrants in our jail. Three of them were driving, never had a license, and ended up killing someone. The fourth one never had a license, was driving under the influence, and also killed somebody,” the sheriff told 12 News.
Update: (Saturday):
After this story was publicized, local officials, including Governor Ron DeSantis (R-Fla.), intervened to pressure ICE to reverse course, the Martin County Sheriff’s Office reported Saturday morning in another Facebook post.
Juan Jose-Sebastian
Pretty simple - don’t do it.
Rapist should have been eliminated. Make America Safe Again.
Anyone have any objections to releasing him in the middle of the Everglades?
“...After this story was publicized, local officials, including Governor Ron DeSantis (R-Fla.), intervened...”
After.
How nice.
Another good time for no comment.
Pretty simple - don’t do it.

The sheriff is looking for an excuse to release, rather than doing his sworn duty to protect the citizens of his county. Sheriff needs to grow some gonads and go back to class to learn what are his duties and powers as sheriff.
“Alleged” RAPIST!
The middle of nowhere, right before sunset, 50 yards from a bait car, all alone. Guaranteed the hombre hasn’t learned anything and can be picked up within 20 minutes for driving without a license again.
EC
Or you can take him for a swim...in the Gulf Stream. It’s only
a few miles off of the Martin County coast. Hell, You can use
The martin County Sheriff’s boat. )))
