Judge Overseeing Trump’s Jan. 6 Case Rules Against Jack Smith

A federal judge ruled against Jack Smith in the ‘election interference’ case against Donald Trump.

The judge restricted Smith’s actions after Trump’s legal team accused Smith of violating a stay order.

Trump’s team appealed to determine if he’s covered by presidential immunity.

The judge agreed with Trump’s team, restricting further substantive pretrial motions.

However, the judge refused to hold Smith and his prosecutors in contempt due to unclear restrictions.

"The court agrees … diligent defense counsel will need to conduct a preliminary review of each substantive motion the Government files in order to know whether they need to take further action. While that is not a major burden, it is a cognizable one,” Chutkan wrote.

“Accordingly, the court will adopt Defendant’s recommendation that the parties be forbidden from filing any further substantive pretrial motions without first seeking leave from the court,” she wrote.

“Any such motion for leave to file shall state whether the proposed motion is ancillary to the pending appeal and so requires a timely response or other action before the mandate is returned,” she added.

In a separate case, a judge removed Fulton County District Attorney Fani Willis from a 2020 election case over political bias and personal involvement with a special prosecutor.

In a separate case, a judge removed Fulton County District Attorney Fani Willis from a 2020 election case over political bias and personal involvement with a special prosecutor.

This is the big news in this story.

Willis was removed by a judge in a separate case not related to Trump.

When a case is already stayed, it means that the proceedings or judgment have been suspended or put on hold, pending further action or a decision.

But as always, there is a howeveer woven in to the decision:

So we all know why Chutkan refused to hold Smith & his prosecutors in contempt, but tell me what could be unclear about the stay's instructions? Sounds like that may have been intentional to see what the defense attorney's might miss.

More shenanigans in the corrupt D.C. court system.

It is also a big lie. No one removed Willis from the case. They only allowed for Trump to ask to have her removed from the case.

utter nonsense ... georgia appellate court just agreed to hear the issue ... could be months before a decision is made ...
