Does the Department of Homeland Security have powers of Arrest?

I have received an e-mail from a former co-worker, telling me that another former co-worker was hauled away in handcuffs by 'The Department Of Homeland Security'

Something is fishy in this story.

First, it was the woman, she is a Catholic, Polish immigrant who has lived here for about 10 years at least.

While I dont know her other than from work, I cannot imagine her being involved in anything that would be considered a threat to our nations security.

She is not married to an Arab, or a Muslim.

Go through the list:
Immigration
Customs
Secret Service
Coast Guard
Border Patrol

Lots of powers of arrest there.

The man in this exchange with me is real, his name has been changed to provide anonymity, but I trust his information as to this happening, he is quite respectable and reliable.

Here is how this evolved:

Hi Jim, it’s been a week now since the Homeland Rangers took Grace away from work in handcuffs. No one, not even her sister has heard from her since.

On another, but similar subject, the town of New Britton wants to convert the Stanley bldg. into a training academy for future Homeland Rangers and use “Socially Challenged” youth to fill the classrooms, Sound familiar? If not look up “Hitler Youth Movement” and if memory serves me Mussolini was doing the same thing with their delinquent youth.

Groovy huh? When the Constitution guarantees “No federal police”, there are 800,000 of them and growing, not scared yet……They all fall under the Judicial Branch. Cop, lawmaker and judge, all in one, how convenient and better yet, no accountability. TROY

Here is my first response, I thought this was some kind of joke at first.

Are you serious?? Grace was an illegal alien??

I had no idea why this woman would be picked up iin the first place, so I assumed she was not here legally, and the part about 'homeland security' was a joke.

Here is his response:

How did you know that??? She was not informed of why she was being arrested and her family and friends have no clue, is this the new american way?? Original message attached.

I didnt understand, this was profound, so I wrote back:

Now, are you serious? Who came and took her? Regular police?

When you said homeland security, I thought you meant immigration as a joke, who came and arrested her??

I thought this was a joke at first, who arrested her? What happened?

His response:

Jim, two woman came to XXX XXXXX XXXXXXX and identified themselves as "Homeland Securety Agents", they took Grace away and as you know they do not have to explain anything. Phylis said they did not tell Grace or her what the charges were. I never said Immigration, You did. NO JOKE!!!!!

I was stunned. So, I tried to make a joke back, hoping to call him later, and said:

I am stunned, Grace is really an Arab??

I had no clue what was going on. This is America, unless youhave some contact with some terrorist groupd or people associated with them, I cannot imagine this happening to any big haired Polish Immigrant.

His response:

Jim, I never knew you had such a Barbara Streisand, Sean Penn sense of humor. I mistakenly thought you gave a shit about what is going on in a country we both put our lives on the line for in the past. I know you don't care much for Grace, but I remember when being sworn into the Army the part about "Upholding the Constitution" do the Marines have a different one or did you forget? So where in the "Constitution" or "Bill of Rights" does it say it's ok to restrain people without charge or evidence? Is it a joke where it says in the Pledge of Allegiance "Freedom and Justice for all"?

Please Jim, before you join the Nazi party read your history books.

"Of course the people don't want war....that is understood. But, after all, it is the leaders of the country who determine the policy, and it's always a simple matter to drag the people along whether it's a democracy, a fascist dictatorship, or a parliament, or a communist dictatorship. Voice or no voice, the people can always be brought to the bidding of the leaders. That is easy. All you have to do is tell them they are being attacked, and denounce the pacifists for lack of patriotism and exposing the country to danger. It works the same in any country." ------- Hermann Goering (Adolf Hitler's deputy) at the Nuremberg trials, 1946, quoted in "Nuremberg Diary" by G M Gilbert

So, this is the last answer I have to him, some things just dont make sense here, so I asked him this. And here is where I am looking for information, whoever knows anythng to the contrary, chime in here:

Has sniffing sheet metal blueprints caused you to misunderstand sarcasm?

Of course I think this is serious, I just cannot imagine it actually happening!

I would want to ask a few more questions, like, what kind of badge these people had when they came to pick her up, for as far as I know, the Dept of H. S. does not have arrest powers, they are a bureaucracy, not an agency with trained agents, so from the start, this sounds fishy. If some FBI or State Police showed up, and said they were there because of Homeland Defense, that is more plausible, but this new agency has not even had an office for 6 months, so something sounds stupid here.

800,000 agents? Since 10 months ago? (That is the number in your first e-mail) You better re-think that number, if there were that many people in ‘Uniform’ our unemployment problem would be solved in this state alone, for that is 3 times the number of Marines we have in uniform right now, including reservists.

Number 3, Grace? For what? Bad hair? Think: Even Hitler Youth needed a reason when they started, not just anyone unless they were in a mob on a killing spree, and what in the world was Grace into by any stretch of the imagination?

Either we are living in a state of total dictatorship, where Grace was pulled off to a Gulag, or this is a hoax of some kind, or someone got some information wrong. This is a HUGE story for the papers and news media, just look at the stories I send through e-mails about people on dams, like big white guys, and since I was not arrested, that was not really news anyways, but look at all the other ones. If people were really disappearing in this day and age, how in the world can you keep this quiet? Too many people in the media distrust Bush, and if the people who saw this woman get carted off, and now a week later no one has heard from her, no contact with a lawyer?

Unless they have strapped Grace to a table and the rats are feeding off her, this sounds like a millionairess after the book and tv movie are made on this abuse of power you are talking about. At least the ones we know are being held are relatives of the known terrorists or something similar, and in this day and age, too many people are willing to mis-use the freedoms we have to kill us. I could not care less about the Arabs being held. That is correct profiling. As soon as Irish Fundamentalist Protestant white guys start bombing, then they can go after you and me like they are doing for the Arab Muslims.

My Point in that last Paragraph; For what possible reason would ‘Homeland Security’ want to hold Grace without bail, and how come we know of all the other families of those being held without bail, but no one from Grace’s family knows about it? There are lawyers up the um-yang waiting to pounce on the constitutionality of this apparent suspension of habeas corpus because they know people are being held without charge and they know where these people are for the most part, and they know it is the FBI that is holding them.

But you are trying to tell me that ‘Homeland Security’ is holding Grace, she has had no contact with her family, no one is answering the phones when her family calls and asks, they didn’t go to the media to make this a public issue to force the Govt to put up or shut up, and that people in Brown Shirts are watching her house???

So, Who knows what?

provide me a link, Let's talk about this, what other instances like this are happening.

800,000 agents? That is your first clue this is comming from someone who is emotion rather than fact based. I would not believe it.

Something fishy, I agree.

Do you personally know this woman? You have met her?

Her employers are completely in the dark as to what has happened to her? They have not gone to the media, at all?

Part of trying to cut through the night and fog involves giving details that people can verify for themselves. Not giving details that anyone can verify for themself makes people wonder if their chain is being jerked. Perhaps not by you, but by someone who you know. Perhaps by the friends of this woman.

Yes, I know this woman personally. Havent seen her in almost 2 years myself, but I know her. The guy who wrote this to me was one of my best friends there at that job, too, so I know the source.

He just responded to me in a new e-mail, that that is all they know. no one has seen or heard from her since she was taken away in handcuffs by people who identified themselves a HOMELAND SECURITY agents!

To the best of my knowledge, there is no Homeland Securuty Rangers, homeland security is a collection or umbrella of different organizations, i.e. coast guard, immigration, etc. They would have most certainly been more specific, if this really happened, it wasn't the government that did it.

I wonder if people are going to try using homeland security as a ruse for kidnapping?

He is not lying about the event. I can check this with too many other old friends there, so I totally trust that this event happened. Plus I know the guy, he isnt some kook.

I just cannot believe this event happened.

Sorry, I was looking for some information that could be independently verified. Not some word about someone you knew 2 years ago.

A name, a place. Some information that people could use to find out what the deal is.

The Homeland Rangers idea was highlighted in a sarcastic column in the Sierra Times.

This seems a little fantastical to me. 800,000 socially challenged kids in New Britain might be a little noticeable (even in New Britain), considering that the Stanley factory is in the middle of everything.

I see you got banished to chat.

Section 812(a) authorizes Inspectors General and their assistants and agents to make criminal arrests without warrants for any Federal felony if they have "reasonable grounds to believe" that the subject committed or is committing the offense. ..... The Inspectors General, their assistants, and agents must accordingly have probable cause before making an arrest pursuant to this section.  Homeland Security Act -- Statement by the President November 2002

His term Homeland Security Rangers is a joke term, not meant to be a real office.

As for kidnapping, not this girl.

Obviously a more important concern than getting the truth out in a form that gives everyone every bit of confidence that soemthing untoward has happened.

You are right. It is much better that if you call into question every public servant, and to make people wonder if the government is making people disappear into the night and fog, while not doing everything you could to convince people in case this girl really is having her rights abused. Your friend's job is much more important.

and identified themselves as "Homeland Security Agents",

Too the best of my knowledge as an law enforcement officer in the DHS, their is no such critter as a "Homeland Security Agent".

I was an Immigration Inspector before being rolled into the DHS, and I'm an Immigration Inspector still, I just work for a different agency.
