The legal argument Biden’s lawyers made to the Supreme Court is that Texas, by constructing the razor wire barriers were blocking the federal government representatives from getting to the border and doing their jobs which is assigned to them under the Constitution.

This is the argument that swayed ACB. The problem is, once they “get to the border” they are escorting the illegals in under the guise of “arresting them” and then releasing them into the country. Thereby refuting their own argument that they need access to the border in order to defend the border.

Texas rightfully argues that this is NOT defending the borders and points to the Constitutional support that holds where the federal government does not defend the border the state has a legal right to do so by default. That is why 25 GOP governors (even squish deep state weasels like Ohio’s Mike DeWine) agree with the soundness of the legal position.

It is on-line in a detailed letter Abbott issued Wednesday. Brilliant argument.
