SAN DIEGO Neighbors shot and killed a man violating a restraining order early Friday after his ex-girlfriend found him inside her University City apartment, police said. William and Nicole Porter, both 22, were each booked on one count of murder, Capt. Mary Cornicelli said. The 47-year-old victim hasn't been identified
Admittedly, not all the facts are known here.
But this is an illustration of the futility of having “ A RESTRAINING ORDER”.
The Judge will not be there to keep the guy off or away from you.
Thr local police are tied upon crimes already committed and can not do anything unless the perpetration is clearly in violation.

Yeah. I wondered about the charges too. The “victim” was yelling “’Come on out. I’m going to kill you,’ “.
That’s what I was wondering. Why not manslaughter?
Yes, this was in Kalifornica where self defense or defense of others is a crime unless you are a member of the gang that can legally kill people.
Defined as the means and intent to kill someone and then doing it.

What? Did they get him in an ambush or a crossfire? sheesh! There have got to be facts missing from this case.
Reading the whole article states the Mr. Porter left the apartment armed to confront the ex-boyfriend. My question is why leave? Just stay inside, call the police and let the police take care of the situation.

Unless I woke up in the wrong country the last I heard neighbors are not in the business of enforcing restraining orders. They will need to prove they had a reason to intervene, such as he was beating on the woman at the time.

This is why I will not willingly go back to the Peoples Republic of California. I thought the 9th Circus Court allowed you to defend life and from bodily harm, but not property (someone please get me out of their jurisdiction). I live in Idaho now and the CCW laws are reasonable and for an upstanding citizen it is very little trouble to get your license. The wife and I go everywhere armed (except those places prohibited by Federal or State law).
The individual going to the womans aid should be commended not condemned for risking his life (and now liberty) to save hers. The world is truly upside down.
Start a fight with a presumably unarmed person who isn’t on your property - and then finish it with a gun? Oops. They’re going down.

He was yelling for them to 'Come on out. I'm going to kill you,' Cornicelli said.
Then, Cornicelli said, William and Nicole Porter each armed themselves with a handgun.
And then Mr. Porter, obviously feeling threatened for himself, his wife and the other woman, decides to go outside and attempt to hold the suspect for police, Cornicelli said.
He left the apartment with his gun and went downstairs to confront the man, Cornicelli said. Nicole Porter stayed on her balcony, which is directly across and above the ex-girlfriend's place.
The two men argued and then fought in a grassy area just outside the apartment. The man was shot.
We believe, at the same time, Mrs. Porter fired from the balcony as well, Cornicelli said.
Cornicelli wouldn't say whether the victim was armed.
All I can tell you is the deceased did not show or display any weapons, Cornicelli said.
These people are so screwed. The guy had left. They chased him down, started a fight and then shot him. You have no right to self-defense in a fight you start unless you attempt to retreat from it and the other guy keeps coming.

Police have two days to present the case to prosecutors, who will decide whether to charge or release the Porters.
I'd say "release". But then again, I'm not %$#%ing INSANE!!!
If they both shot him during a fistfight outside, him unarmed and her shooting from a balcony, then that is murder and they are in for the whole 9 yards.
Hell, that sounds like they were just waiting for the chance to kill this guy
Were it not murder, then anybody who didn't like you could use that MO and that excuse oto kill you and anyone else. - think about that
