However, the judge unexpectedly called the Red Rose Rescue case first. This was unusual, according to LLDF, because the courts usually opt to get through procedural and other less time-consuming matters before calling up trials such as the one involving the Red Rose Rescue. LLDF reports that the judge asked the parties whether they were ready for trial, and U.S. Attorney Jana Maser, who was prosecuting the governments case, replied that she was not ready, because she could not produce any witnesses. I'm guessing they were counting on being called later and figured they had time to show up.
Too bad for them. Good move on the judge's part.

However if this case went through the court would have had to face the contention that a life was in danger and intervention was necessary to save that right contraveneing trespass laws.
A clear setup to force the court to rule on whether a child in the womb is alive.
Could have ridden that to the Supreme Court.
Less miracle and more cowardly on the part of the court in both cases.
