Fla. halts sex offender racy reading (Maxim gets ya jail time if you're a sex offender)

MIAMI (AP) - Authorities in Florida are sending convicted sex offenders to jail for violating the terms of their probation by having men's magazines such as Maxim.

Andrew Calderon, 23, was jailed for six days before a judge ordered his release after officers found a racy poster and calendar and copies of Maxim in his home earlier this year.

A judge will decide next month whether Calderon's probation should be revoked or extended and whether the materials were innocent.

Corrections officials said Calderon, who was on probation for the sexual battery of a mentally disabled relative, committed a violation by having "sexually stimulating" material.

But in court papers, Calderon's lawyer, Mel Black, described Maxim as far from obscene.

"This is beyond schoolmarmism here. It's really mind-blowing," Black said.

In another case, sex offender Joseph Conte, 56, was arrested when authorities found a copy of a sex manual in a drawer next to the bed the former schoolteacher shares with his wife. A judge later dismissed the probation complaint.

Florida authorities have increased their surveillance of sexual offenders since two young girls were slain earlier this year, both of them allegedly attacked by sex offenders who were free on probation.

Um, as far as I know, Maxim shows a bunch of legal-age, clothed WOMEN. I'd hate to see if they start raiding the guys house for Hustler.

the issue is one of urges and folks that get them and what keys them..

a sticky wicket of an issue, but Florida is better off over-reacting than losing more kids, No?

It's all part of Terms and Conditions when thye go free.. standard stuff.

Florida may finally be forced to get Draconian,, and some folks may get caught up in it. But it's not like they weren't warned either or that they signed off and agreed to the terms of their release.

A few recent victims would agree, I am sure.

Is there any evidence that A leads to B here? How is having a copy of Maxim any different than going to a Florida beach?

Studies have been done as to what stimulates folks.

A hypothetical for you..

If I put a gun in one of your hands and a bullet in your other hand,, and then you get an urge to shoot someone for what ever crazy reason,, who is guiltier of a crime? You or the one who didn't try and prevent it, or both?

To some, not all sexual offenders, the ammo could be as simple as a magazine.. These folks are sick after all, right?

I think what may be going on here is that it's almost impossible not to violate some condition of parole or probation - giving LE the power to selectively enforce it, determine who "needs" to go back.

I guess we're left with trusting LE's judgement in a lot of cases.

I hate to say it but this will never pass constitutional muster. The High Court ruled in the early 1990's that it was a violation of a criminal's 5th Amendment protection to register a firearm he held illegally because in so doing he would be in effect giving forced self incriminating testimony. The First Amendment will be given similar coverage in this case, especially where the subject material meets local standards in the Miller Test for obscenity.

Speaking as a former State of Florida Probation and Parole Officer myself let me just say: YUP.

To enter into Probation in the first place an offender must voluntarily sign away all fourth Amendment protections in regards to his probation officer. Regular police must still secure the proper warrants to investigate a new offense, but the probation officer can search anything, anytime, anywhere. I could search the offenders person, vehicle and effects on the street anytime I pleased. I generally didn't, but I could and they couldn't say boo and they knew it.
