A three-judge panel heard oral arguments on Tuesday and appeared skeptical of Trump’s immunity claims – one judge, a Biden appointee, asked attorney John Sauer if Trump would be subject to criminal prosecution if he ordered SEAL Team 6 to assassinate his political rivals.

“Could a president who ordered SEAL Team 6 to assassinate a political rival, and is not impeached, would he be subject to criminal prosecution?” Judge Florence Pan, a Biden appointee asked John Sauer.

John Sauer, former Solicitor General of Missouri and friend of The Gateway Pundit, replied, “If he were impeached and convicted first… my answer is qualified yes, there is a political process that would have to occur under the structure of our Constitution which would require impeachment and conviction by the Senate in these exceptional cases…"

Of course this is an absurd hypothetical question that echoes Jack Smith’s argument to the federal appeals court.

To no one’s surprise, CNN was having a field day with this and piled on John Sauer.

Has everyone forgot that Obama ordered a hit on an American citizen when he was a Usurper? Seems this three panel court has it in for Trump.

That is a fair question.

I hope his lawyers reminded the judge that Trump and his lawyers specified actions that required him to enforce LAWS as per his oath of office.

Asking Congress to examine elections is covered in the Constitution.

Obviously unlimited immunity would be a gross violation of basic human law. In this case however Trump truly believes that the election was stolen. And it is actually his responsibility to try and get to the truth of the matter.

The correct answer is no. He could not be charged. He could be impeached. If convicted by the Senate and removed from office, he could then face prosecution. Impeachment and trial in the Senate is required for presidents. The Founding Fathers specifically set it up that way to ensure no rogue prosecutor could use lawfare to affect policy.

At least that’s what I would have answered.

She lives in movie/TV land, she didn’t just say have someone assassinated or even have the military assassinate, she said SEAL Team 6.

Well, pResident barry soetoro used Predator drones and Hellfire missiles to assassinate US citizens, including a 16 yr old, and he wasn't impeached or charged, so, yeah, why not?

This whole issue of Presidential immunity has been addressed before and the DOJ has consistently held that Presidents cannot be prosecuted for actions taken in their official capacities as President. Presidents take an oath to uphold the Constitution and the laws of the land therefore if the President cannot verify the legitimacy of a close election who can?

Well, that seems like the correct answer to the question.

Now if somebody were brand new to our Constitution and how it worked, that kind of hypothetical question might make sense to ask, but not sure its something an experienced judge should even be confused on.
