CNN senior legal analyst Elie Honig said Tuesday on “The Source” that during the New York business record case, adult film star Stormy Daniels’ cross-examination by former President Donald Trump’s lawyers was “disastrous.”
Honig said, “It’s hard for me to believe that a juror heard that and thought, this is entirely made up. There may well be some embellishments…but I think it’s quite clear they had sex in 2006 in that hotel room. But the cross-exam, boy, her responses were disastrous. I mean, ‘Do you hate Donald Trump?’ Yes. Of course, she does. That’s a big deal. When the witness hates the person whose liberty is at stake, that’s a big damn deal. And she’s putting out tweets, fantasizing about him being in jail. That really undermines the credibility.”

Let me remind the readers that a NY appeals court overturned the Harvey Weinstein rape conviction because the prosecution presented irrelevant and salacious evidence that unduly influenced the jury. The whole day today was nothing but irrelevant and salacious evidence.

I didn’t think the fact they had sex was even in doubt.
The defense could have stipulated that. I understand why they didn’t…but to suggest that fact was a big deal in this case is missing the entire point the prosecution is trying to make.
The prosecution just wants to talk about sex stuff. That’s pretty weak and sad.

What gall from the judge to tell the defense they should have objected. They did before she even took the stand saying she had no information in regard to the alleged crime. This should have been a mistrial.
