The U.S. Supreme Court on Monday denied an appeal from California corrections officials who sought immunity from lawsuits claiming they acted with deliberate indifference when they caused a deadly COVID-19 outbreak at one of the world’s most famous prisons four years ago.
The justices turned down the appeal without comment or dissent.
The lawsuit stemmed from the botched transfer of infected inmates in May 2020 from a Southern California prison to San Quentin, which at the time had no infections. The coronavirus then quickly sickened 75% of inmates at the prison north of San Francisco, leading to the deaths of 28 inmates and a correctional officer.
California now faces four lawsuits from the relatives of those who died as well as from inmates and staff who were infected but survived.

BTW, the Court has an opinion day scheduled for tomorrow. They have about 40 cases remaining to issue Opinions on for this term and approxmiately six weeks to do so. We should start seeing two opinion days per week soon.

I haven’t heard of any suits against nursing homes for the same actions although I would think they are out there. I recall government agencies putting Covid patients in nursing homes knowing that the most vulnerable were being put at risk. NY, Michigan, and I believe California all did the same. Meanwhile, red states were trying to protect the elderly from the virus.
Might be interesting if this touches qualified immunity for all state actors, like police and such.

There was no new, deadly virus. There were plenty of newly untreated bacterial pneumonia cases and other new policies and payoffs leading to massive killings.
Dig deeper to find if correction officials held life insurance policies on the victims.
Good, now do Cuomo’s executive order in NY sending infected COVID patients into nursing homes and long term care facilities as the US Navy’s Comfort Ship sat with 90% of its 1000 beds empty and the same with the Field Hospitals.

Lawyers are probably trying to find just where the bucks stops so the right parties are sued.
I have not read the ruling but I think it likely it was found that there was a possible or even probable violation of inmate’s civil rights. Cases involving such violations are not protected by sovereign immunity.
There is also the whole duty of care which THE POLICE DO NOT OWE THE GENERAL PUBLIC. It may be that because prisoners are essentially obviously under the care of the prison such a duty of care is owed.
Just supposition on my part mind you.

The worst part was that in mid-March Trump ordered CMS to change its regs to allow residential care dlfacities the amity to refuse.
Cuomo in May ordered them back anyway.
The facilities complied.
Rumor had it that facilities that wanted to refuse were threatened with fines and nightmare inspections.
