Calif State Senator To File Suit Wed To Void Elec Deals

LOS ANGELES -- A California state senator will file a lawsuit Wednesday to void all the state's long-term electricity contracts based on an energy consultant's alleged conflict of interest, said a spokesman for Sen. Tom McClintock, R-Thousand Oaks.

The lawsuit, which will be filed in state superior court in Pasadena, will claim that Vikram Budhraja violated California's government code when he helped negotiate on behalf of the government $43 billion in power contracts last year while being paid a consulting retainer by Edison International (EIX), McClintock spokesman John Stoos said Tuesday.

I think the key to McClintock's interest may be the discovery process conducted within the governor's office and SCE. If one is looking for campaign dirt that is surely one way to get it. The problem is that there is probably so much dirt one wonders if he is going to need an excavator. The chore will be sorting it into a coherent picture.

Consider how long Bryson, Peace, Harvey Rosenfeld, Nettie Hoge, and Davis have been in bed together, 20 years? Wouldn't YOU as a Republican love to expose this long standing gambit (extending over decades) of creating a shortage by funding NGO lawsuits against non-fossil fuel power companies and cashing in on the shortage to force "conservation" and play carbon credits to "help the underdeveloped countries"? Think of the NRDC shutdown of Rancho Seco, the Sierra Club nimby suits agains Diablo Canyon, the games being played by rafters over flow rates through hydro dams, the shutdown of forestry that could create biomass, the outrageous price that MUST be paid to wind and solar power generators, and the particulate and NOx regulations that concentrate virtually ALL electrical production into one resource: natural gas. Meanwhile they expand the demand for natural gas as much as possible by increasing the fraction of MTBE required in reformulated gasoline (it lowers mileage almost half as much as the amount that is added, so there has to be a net loss of energy by mandating it). Needless to say there are no new pipelines either. Viola! A shortage; and the price of gas goes through the roof. Souprise, sureprize, so prise!

Ahhhh........ This makes sense. Yes exposing NRDC, Sierra Club, et. al. would be wonderful, if the media will publish the story.

OK, I stand corrected, this make political sense, as opposed to legal or economic sense!

The Senator has standing as a California taxpayer.

Unless there is a special provision in the conflict of interest law, status as a taxpayer isn't sufficient to confer standing. That's why ordinary citizens can sue to void all of the unconstitutional things (for example, the departments of education, housing and urban development, etc.) the Federal government does.

It's war, and McClintock is no dummy. This is also probably a good career move as well. We really need to get rid of Bill Lockyer.

Very nice summary. For the record, these clownettes were the most visible activists against Diablo Canyon. Others probably funded them.

They're been trying to shut down Diablo Canyon for 25 years, and are still at it.

Senator McClintock does have standing as a citizen and ratepayer. In addition, co-plaintifs include organizations like People's Advocate and The Merit Shop Roundtable that have hundreds of thousands of members.
