It's possible that enabling legislation for a referendum in California specifies that the law must be enacted before the signatures are collected. It certainly wouldn't be proper to collect signatures while the bill was being ironed out in the legislature, for example. Otherwise, you could start collecting signatures every year when the legislature opens, and that makes no sense.
