Fence execs sentenced for illegal hiring

SAN DIEGO - Two executives at a company that once helped build a fence to keep illegal immigrants from crossing the Mexican border were sentenced Wednesday to six months of home confinement for hiring undocumented workers.

Mel Kay, founder, chairman and president of Golden State Fence Co., and manager Michael McLaughlin had pleaded guilty in federal court to knowingly hiring illegal aliens. U.S. District Judge Barry Ted Moskowitz ordered each to serve 1,040 hours of community service and spend three years on probation.

As part of the punishment for being caught over here illegally, the 'immigrants' should be force to spend 6 months building the fence before being deported.

All of Kay's workers paid Social Security taxes and received health benefits, vacation and sick time. Many earned more than $50,000 a year.

"Paid Social Security"...notice income tax wasn't mentioned? My sister transposed one digital on her tax filings two years ago. The IRS caught the error without problem.

$50K job no American wants.

Golden State Fence Issues Statement on Legal Proceedings SAN DIEGO, March 28 /PRNewswire/ -- Golden State Fence Company, one of the nation's leading fence design and installation companies, announced today that a San Diego Court sentenced Mel Kay, the Company's President, and Mike McLaughlin, another senior executive, to serve only three years probation and no time in prison.

In addition to probation, both men were sentenced to a period of home detention, 1,040 hours of community service and to pay fines of $200,000 and $100,000 respectively for the hiring of undocumented workers.

"We are grateful that the judge chose probationary sentences rather than incarceration. Mel and Mike are hard working men who have worked all their lives to make a better life for themselves and the people around them," said Executive Vice President Gary Hansen. "Their acts were not egregious, nor were they exploitive to the undocumented workers. We believe the court recognized the strength of their character when making its decision.

"We would also like to thank our customers and members of the community who supported the Company during this challenging time."

In explaining his decision not to impose the maximum sentence of five years, the Honorable Judge Moskowitz said, "A company that pays top dollar and did not get a competitive advantage, should receive different treatment. The Court cannot ignore the background of hard working people who treated others fairly. Contrary to the vast majority of people who hire illegal immigrants, there was no abuse [here]."

Judge Moskowitz also stated that Golden State Fence had devised an A-plus system for dealing with the situation by creating a model that other companies should follow to avoid hiring illegal immigrants.

The Company noted that the A-plus system cited by Judge Moskowitz referred to the corporate immigration compliance program that Golden State has voluntarily participated in since December 2005. The Basic Employment Verification Pilot program is run by Immigration Customs Enforcement (ICE), through which newly hired employees are screened by the government to help verify their legal immigration status. Its participation in this program has allowed the Company to lead its industry in combating the hiring of illegal immigrants. Golden State Fence encourages other companies in the fencing business to also participate in this government program.

Your cut-and-paste completely avoided the question of who they built this fence for. According to the story, which was conveniently unnecessarily excerpted, the company built fences for the government, not any private group which you're trying to imply.

You're not nearly as good of a propagandist as your boss Sun Myung.

The fact that they're a Moonie rag and have printed full-page ads about that nut being the messiah and claiming that he had a meeting with Jesus and other religious leaders in which Jesus said...

In 1999, Golden State Fence Co. helped build a 14-mile border fence between California and Mexico. They have now been fined almost $5 million dollars because close to 1/3 of their labor force was made of illegal immigrants. Golden State’s attorney while acknowledging the company used the illegal immigrants and broke the law said this proves the need for a guest worker program.

The multiple levels of irony would be funny, if this weren’t so sad. Of the many failings of the Bush administration, lacking the willingness to tackle the critical issue of illegal immigration stands close to the top.
