Pa. House approves "Castle Doctrine" legislation and sends to the Senate for consideration

The state House voted 159-38 to pass legislation that self-defense advocates have pushed that would generally allow the use of deadly force in a home or occupied vehicle to protect the occupants inside.

This so-called “Castle Doctrine” bill is named for the expression that “a man’s home is his castle.” According to the National Rifle Association’s website, 25 states have enacted versions of the Castle Doctrine.

Why would an American need permission to use deadly force to protect oneself or one’s family?

It’s not permission it’s clarification and protection, and it’s needed because district attorneys are usually graduates of American law schools.

I hope we soon can read about a happy ending to a home invasion as a result of passage of the Castle Doctrine law in PA. People who invade homes for any reason deserve to meet justice from a loaded shotgun.

Not from PA. But if the numbers in the state Senate are similar in ratio to the House I doubt any veto will hold up. I don’t follow the states politics closely, will Rendell veto in the face of a likely over ride? I don’t know.

There are several enemies in the next few steps but the biggest is time. There are only three working days left for the Senate this session - after that, the process starts all over again next year.

We must get this bill out of committee and get it approved - WITHOUT AMENDMENTS - next week in the Senate when they are in session (12th, 13th and 14th)!! We are in the majority in the Senate, but that doesn’t mean that the Democrats will sit back and let this happen!

Rendell hasn’t indicated whether or not he will sign it. I don’t think it’s a dead giveaway that he will veto. But if he does, we of course have the votes - but may not have the time - to override it!!

2/3rds majority in both houses, starting with the originating house.

It passed the House 159-38 (78.7%).

We have a 30-20 majority in the Senate (60%) and would need just four Democrat votes (as I see it, maybe it’s three).

So overriding a veto politically is likely not an issue. Timewise, however, it would be extremely challenging - and may require a special session of the Senate, which is rare.

The other situation, if Fast Eddie doesn’t want his Dems to take heat in November is to simply not sign it - it becomes law after 10 days at his desk.

Thanks for the info. We got a somewhat watered down version here in Ohio last year. We are protected in our home and auto, but it doesn’t go as far as some ‘Stand Your Ground” laws in other states.

Still, I’m not complaining. Stuck with a Democrat for a Governor, Strickland is a rare bird as a gun rights supporter.

Ditto on the current Democrat attorney general.

Republican John Kasich will be the next Governor, his record is good but not great. My worries here will be the IDIOT Republican running for attorney general, Former Senator Mike Dewine. One of the only Republicans ever endorsed (And enthusiastically accepted) by the Brady Campaign to Prevent Gun Violence, he has not since gotten my vote and WILL NOT ever again get my vote.

If this means puling the lever on a “D”, so be it. I can live with it.

Any Republican endorsed by the Brady campaign should be disavowed by the GOP.

IMO.
