Judge rejects Trump bid to delay New York fraud trial

A New York state judge on Wednesday rejected Donald Trump's bid to delay a scheduled Oct. 2 trial in state Attorney General Letitia James' civil fraud lawsuit accusing him, family members and his business of overvaluing assets by billions of dollars.

Trump and the other defendants had said the trial should be "briefly" delayed until three weeks after Justice Arthur Engoron ruled on both sides' requests for summary judgments, which seek victory on various legal issues without the need for a trial.

In a Tuesday night court filing, Trump accused James of "callous disregard" of a June 27 appeals court decision that prevented her from suing over loans that took place too long ago, "substantially" limiting the claims remaining for trial.

But in a one-sentence order, Engoron called Trump's arguments for a delay "completely without merit."

The judge had earlier this year said the Oct. 2 trial date would not change "come hell or high water." *** Separately, the defendants on Tuesday demanded that James withdraw what they called her "frivolous" motion to sanction them and their lawyers $20,000 for rehashing what she called their "frivolous" legal arguments on multiple issues.

On Wednesday, James refused the demand, saying that just because there was now a more "complete record" did not make legal arguments that courts have repeatedly rejected any better.

James is suing Trump, his sons Donald Trump Jr and Eric Trump, and others for allegedly inflating asset values in a decade of annual financial statements to obtain better terms on loans and insurance.

The attorney general said the fraud enabled Trump to inflate his net worth by as much as $2.23 billion, and that he should be found liable for fraud even before a trial began. ***

The business of inflated asset values and Donald Trump has a very long and well documented history.

The problem was the Forbes list. Forbes published an annual list of I believe billionaires. The net worth value for each person on the list was published. Trump always complained that his number was under valued and provided a figure that Forbes always said was significantly over valued.

Forbes always published the value it’s crew determined while also publishing the fact that Trump not only complained but provided an inflated value that was not justified.

This ongoing battle over many years is detailed in the Forbes One Hundredth Anniversary issue published in 2017. There are several other Trump semi derogatory related articles in that issue

So, in essence, the Trump hating New Yorkers ganged up and using the various numbers he provided are having a merry old time beating him up.

So, bottom line......... Trump did it to himself

It doesn’t matter what he said publicly or not. It matters what his accountants, evaluators etc. can prove on a balance of probabilities. If Trump in good faith based his claims on professional valuations that just emphasizes his justified public assertions but even if he disagreed with the financial data either his own or generated from an independent source that makes him culpable of nothing. But i hardly think that Trump ‘cooked the books’ personally or at his direction. Ultimately the banks who provide the financing do their own valuations and their negligence is not his liability.

The whole thing is irrelevant. If Trump believes values placed on his property are low he is not alone. He may be right or he may not but it’s an opinion and no one acts w/o getting their own assessment.

Your TDS is showing and it’s ridiculous to suggest that Trump brought illegal & illegitimate procedures on himself by expressing an opinion. The current actions represent malicious prosecution and abuse of process. This includes the ridiculous care of the woman who claims with no evidence she was assaulted in Bergdof Goodmans.
IOW his Bill of Rights protections are forfeit according to you.

These robed men and women rule on high-stakes real estate disputes and rezonings for projects and entire neighborhoods. Lately, some of their key decisions have been reversed on appeal, which suggests they are not doing a bang-up job.

Take the quote above by Engoron, who ruled that four towers proposed by JDS Development, L+M Development, CIM Group and Starrett Corporation in the Manhattan neighborhood Two Bridges required a rezoning, even though they complied with the zoning in place. If that sounds like sound legal reasoning, I’ve got two bridges to sell you.

The developers appealed and won.

All three reversals were unanimous. Do the judges care about being overturned? One would hope. But the court system does not keep track of their reversal rates and their jobs are as safe as houses. They nearly always serve until they hit the mandatory retirement age of 70 (at which point they can request up to three two-year extensions).

I’m sure those numbers come by people preparing his bank requests. Important people have “people” to do the bank thing.

Furthermore, ALMOST EVERYONE COMES UP WITH THEIR OWN IDEA OF WHAT WILL GET A LOAN APPROVED. IT IS THE BANK...THE COMMERCCIAL LOAN DEPARTMENT PERSONNEL...WHO PROCESSES THE LOAN WHO DECIDES WHETHER THE NUMBERS ARE ACCURATE.

This “inflated” number is something that happens EVERY DAY.
Letitia chose unwisely, making her look like the raving lunatic that she is. She is a PUTZ.
