A three-judge panel heard oral arguments on Tuesday and appeared skeptical of Trump’s immunity claims – one judge, a Biden appointee, asked attorney John Sauer if Trump would be subject to criminal prosecution if he ordered SEAL Team 6 to assassinate his political rivals.
“Could a president who ordered SEAL Team 6 to assassinate a political rival, and is not impeached, would he be subject to criminal prosecution?” Judge Florence Pan, a Biden appointee asked John Sauer.
John Sauer, former Solicitor General of Missouri and friend of The Gateway Pundit, replied, “If he were impeached and convicted first… my answer is qualified yes, there is a political process that would have to occur under the structure of our Constitution which would require impeachment and conviction by the Senate in these exceptional cases…"
Of course this is an absurd hypothetical question that echoes Jack Smith’s argument to the federal appeals court.
To no one’s surprise, CNN was having a field day with this and piled on John Sauer.

I listened to the whole thing. The “judges” we overall kind of stupid. But what would you expect with all the affirmative action going on in that circuit?
If you reversed everything these rats would say of course Biden has immunity, next case.

This is absolutely right. Democrat appointed Judges are always liars and or idiots, and they should *NEVER* be taken seriously. They should always be regarded as criminally insane.
The country should simply defy anything a Democrat appointed Judge ever says.
Why do that when you can use a prosecutor?
Let’s say Biden ordered a hit on an innocent US citizen. There is also the 25th Amendment, which could be faster than impeachment, but the current congress would not muster a 2/3 vote for that no matter what Biden did.
Yes, that would be an unlawful order the military member would be criminally liable for if they obeyed. For the president, that would be an impeachable offense.

The Superior Court is a trial court of general jurisdiction, and during Judge Pan’s 12 years of service, she heard a wide range of cases including civil, criminal, family court, and tax matters. In 2016, during her time on the Superior Court, President Obama nominated Judge Pan to the D.C. District Court but her nomination was never considered by the full Senate.
In June 2021, President Biden renominated Judge Pan to the D.C. District Court. She was confirmed with an overwhelmingly bipartisan (??!!) 68-30 vote in September 2021 and has been serving on that court ever since.

The judges just demonstrated their inability to rule without prejudice.
Trump could murder people himself.
He could molest children on camera.
NONE of it is an issue, nor should ever be considered unless and until he *actually* does them, at which point you will have a crime.
I hate communists like that judge. We’re supposed to grant him respect?
