This May Be the Week Alvin Bragg’s Case Against Trump Falls Apart

Even for those of us who have long been critics of the “hush money” case against Donald Trump and its dubious legal theory, it has been surprising to see that the prosecutors had no more evidence than we previously knew about.

The assumption was that no rational prosecutor would base a major criminal case almost entirely on the testimony of Michael Cohen, who was recently denounced by a judge as a serial perjurer peddling “perverse” theories in court. The calculus of Alvin Bragg is now obvious. He is counting on the jury convicting Trump regardless of the evidence.

Which is also why Bragg likely fears that the judge, not the jury, will decide the case. After the government closes its evidence this week, the defense will move for a direct verdict by the judge on the basis that the evidence is insufficient to sustain a conviction.

Well, there is evidence of conflicts of interest and entanglements, but you are right that there is no sign of an actual payoff.

A good chunk of the trial has nothing to do with what he’s on trial for.


And to date, it is not clear what he is on trial for...legally speaking. Practically speaking, it is clear he is on trial each for being Trump, and for being a potential Presidential election victor.

For discussion’s sake, assume that there is a grand cabal of Dems extending throughout Washington DC, NYC, etc. — all coordinating all of this lawfare against President Trump.

To date, the Dems have pressed forward no matter what, never taking a step back after defeats, never regrouping, never changing course.

But the defeats have been so substantial of late, time grows so short, the prospects in November are beginning to look increasinlgy and irreversibly and comprehensively bad, that one has to wonder ... wouldn’t it be best at this point for Judge Merchan simply to dismiss this case for lack of evidence when that opportunity presents?

I am not holding my breath, but I think the answer is resoundingly yes.
