Taiwan High Court sentences man to over four years for raping his spouse

TRIAL: While he claimed that he did not rape his wife, saying that it is a responsibility to have sex when you are married, the high court disagreed

The Taiwan High Court (¥xÆW°ªµ¥ªk°|) recently sentenced a man surnamed Wang, who forced his wife to have sex with him, to four and a half years in prison.

The defendant is allowed to appeal to the Supreme Court (³Ì°ªªk°|) within 10 days of the date when the verdict is received.

The judge took Ms. Wang's testimony, her female colleague's testimony and a report from the hospital regarding Ms. Wang's examination and believes that Wang raped his wife.

According to the indictment, Wang has been violent with his wife and forced her to have intercourse with him for the past two years. However, he denied that he "raped" his wife and said that he accidentally injured his wife while they were having sex.

Wang and his wife got married at the end of 1998. Wang and his wife had different working schedules. The indictment said that Wang constantly asked his wife for sex, even if she was tired. The indictment also said that Wang would beat her up if she refused his advances.

Wang's wife said in the indictment that Wang pressured her for sex again sometime in February of last year. She refused because she needed to chair a meeting the next morning.

The indictment said Wang beat her up after her refusal, which caused her to faint in the office the next day.

The indictment also said that a female colleague of Wang's wife figured out that there was something wrong so Ms. Wang finally told her colleague that she had been "raped" by her own husband.

"I did not rape her," Wang said before the trial. "I believe that having sex with your spouse is the responsibility of a married couple."

Sounds like he didn't respect "Not tonight, I have a headache".
Of coarse men can rape their wives!! Don't you think that much physical force after a wife says no wouldn't be brutal and demeaning?
But you are right, it's difficult to prove, but not impossible. Sounds like they did.

When I say no, regardless of who it is, no means no. Just because one is married, does not mean one owns another. Sensitivy means a whole lot. There are some people that think that having sex is like coming home to eat dinner every night. There are some that think that because you are married, you are a possession. Wang sounds like one of those, especially if he became violent. Who would want to be lovable out of fear. You would only be going through the motions. Which gets old after awhile and one retailiates in one way or the other. Some have a very destorted meaning of marriage.

You both say "yes" at the altar. Then we get into the body no longer being your own, but your spouses also, etc. A christian cannot rape his/her spouse, period. You can be abusive and all sorts of other bad things, but it will not fit the definition of rape.

Of course, this only applies to Christian and Jewish marriage. I don't know about other kinds.

Legally, you're two sepearate people regardless of your religion. If you dont believe it was morally wrong, then fine. But that wont change the fact tha its still a crime.

When I got married, I agreed that my body was no longer my own. My husband and I became one flesh. It is not always easy for us--I'm a morning person and he's a night owl. I would never have believed how difficult it can be for husband and wife to get together with certain differences. We do not always agree about it and we have different "needs." However, the rule always applies. We schedule it if need be, but no one goes long without access to their conjugal right as a spouse.

Hold off on Jewish Marriage.

Nida, the Laws of Family Purity are quite specific here.
A woman is not obligated to have sex with her husband. On the other hand, teh husband is obligated to service his wife so long as he is physically able and if they are allowed to have sex on that day. (For 8 days after menstruation and on certain days of mourning, sex is forbiden).

Rape is possible but hard to prove within marriage.
