Want sensible gun regulation? Start by backing the right to bear arms.

Those dangerous radicals John Ashcroft and Ted Olson are at it again. The Second Amendment, the Justice Department has just asserted in two Supreme Court briefs, protects an individual right. People like you and me do indeed have the right to keep and bear arms.

From the Militia Act of 1792 to the current Militia Act (enacted in 1956), the "militia" has meant pretty much the adult able-bodied male citizenry age 17 to 45. Following the Supreme Court's sex equality decisions of the 1970s, it almost certainly includes women, too. The two clauses both stress the Framers' commitment to keeping the citizenry--not the states or small state-selected groups--armed."

All of the previous anti-gunners' arguments that repeat the old tired mantra that "the Second Amendment applies only to the militia" falls apart in this. It just goes to show how idiotic they are. Any decision that could have been made along those lines would have just "limited" ownership to those groups, since the federal law and many states' law defines what a militia is.

It will be a LONG time before those of us out here forget the reign of Clinton/Reno. Constitution? They didn't need no stinkin' Constitution. Just having the courts reaffirm what we can read for ourselves doesn't mean that the President at some future date wouldn't just turn things around and attempt a confiscation. The author is wrong - we will never submit to "sensible" gun regulation. We already have it - it is called the 2nd Amendment.

We need a case to put to the SC so this can be settled before the next liberal gains the presidency. This position may well be the genesis of challenges to the court. I sincerly hope so.

There are plenty of cases all over the country. The problem with bringing one of them to the Supremes is 'Lawyers, Guns and Money' I think.

The Second Amendment has been infringed for a very long time, despite it's very plain language IN ENGLISH!

I'm having a hard time deciding whether this latest action concerning "Emerson" is a step in the right direction? or a side step in order to avoid a direction?

If militia means "armed forces" or army....how silly would that be. The government granting the army the right to bear arms. And wouldn't the Founders have simply said..."the right of the milita to bear arms....".

But they didn't. The Founders didn't like standing armies and wanted to preserve the volunteer militia (ie "the people").

When the libs get the 10th Amendment figured out...they can work on #2.

Please don't combined the two. Some idiot anti-gunner will try to say that the only ones who can bear arms are guys between the ages of 18 and 45. There is the volunteer militia and the People.
