Documents In Stevens Case Are Requested

A federal judge yesterday ordered the Justice Department to give him documents concerning allegations of misconduct by the team that prosecuted former senator Ted Stevens (R-Alaska) on corruption charges. The order by U.S. District Judge Emmet G. Sullivan comes days after the Justice Department said it would ask Sullivan to throw out Stevens's conviction and indictment....During Stevens's trial, Sullivan repeatedly chastised prosecutors for their handling of witnesses and evidence. A jury convicted the senator in October of lying on financial disclosure forms to hide gifts and free home renovations. But since then, an FBI agent has filed a whistleblower complaint alleging misconduct by the prosecution team, and Sullivan has held three top Justice lawyers in contempt.

In February, Justice officials reviewing the prosecution uncovered notes of a pretrial interview of their star witness. The notes contradicted the witness's testimony that Stevens didn't want to be billed for remodeling work, officials said. The information should have been given to the defense but was not. Sullivan demanded yesterday all evidence handed over to Stevens's attorneys since the trial and all exculpatory material connected to allegations raised by the FBI agent. He also asked for copies of the prosecutors' witness notes...legal experts said the order signals that Sullivan may not let the misconduct allegations drop. He can levy various sanctions, including a fine and jail time, against prosecutors if he concludes they intentionally violated evidentiary rules.

How certain Justice Department prosecutors unscrupulously assisted the Democrats in strengthening their control over the Senate. If you don't think it was deliberate, I have a bridge to sell you in Brooklyn. Judge Sullivan already has held in contempt of court William Welch, head of the DOJ's Public Integrity Section (belying the name of the section he heads); Patricia Stemler; and the chief trial prosecutor, Brenda Morris, who TEACHES LAW AT GEORGETOWN.

They are all liberal holdovers and civil service types. Welch is a registered Democrat with political connections to Massachusetts (Senator Kennedy), who is in line to be U.S. Attorney for Mass. Why do I suspect that appointment will not come to pass? None were Bush appointees. The lead prosecutor is a big BO supporter. As someone on a law blog noted, this is is a golden opportunity for Holder to acquire “principles” now that the damage has been done.

Personally, I believe that whenever misconduct on behalf of a Government Agent occurs, especially in cases where false or misleading information has been given with regards to any Material Fact, said corrupt Agent should be sentenced to the exact same penalty as the person he was trying to railroad would have received.

Government Agent= All persons required by Law or Profession to take an Oath or Affirmation thereof, to uphold, defend, or enforce the Law, or the Constitution of the United States, or of Any State.

I'm not sayingit isn'ttrue, I'm just wondering what it's based on. Open Secrets says there is no Brenda Morris.

Which is kind of wierd...I expected I would have gotten a dozen different individuals with fairly common name likethat, and had to ferret out the "real" Brenda Morris.

This case shows once again that GOP has no spine. Had the roles been reversed, ie conservative prosecutors had done this to senator with D attached to his or her name, Olberman’s head would have exploded, NY Times would have front-page devoted to this scandal every day for weeks and there would be congressional hearings and special legislation for a new senate elections.

Now, nothing. Some GOP senators just say that bad luck. That’s it??

I hate the spineless GOP and I’m afraid that GOP has zero chance of ever again winning anything with this attitude.
You just cannot with this attitude.

The settlement, finalized last week, effectively ends more than six years of legal feuding, which began when Alan Brown's office manager fell for a cocaine smuggler and, in an effort to win her lover leniency, told federal agents that Brown routinely cheated on his taxes.

A Justice Department prosecutor at the center of the tossed-out corruption conviction of former Alaska Sen. Ted Stevens led the failed prosecution of a San Antonio criminal defense attorney that wound up costing taxpayers at least $1.34 million.

Tax fraud charges against Alan Brown took six weeks to try in 2004 and 2005, but jurors deliberated less than an hour to hand the prosecutor, Brenda Morris, a defeat.

Brown sued the government over the tax agents' conduct and after the trial won a $1.34 million settlement.

... Some observers believed Brown's prosecution was doomed from the start, partly because the government's star witness, a former staffer in Brown's office who fell in love with a drug-trafficking client, was deemed not credible. Those familiar with the case said Morris pushed it forward regardless. Before the trial, two judges found IRS agents acted with reckless disregard for the truth when they used uncorroborated accusations to justify an all-night search of Brown's home and office.

She was promoted in August 2006 to principal deputy chief of the Public Integrity Section in Washington and was the lead prosecutor in the Stevens case.

"This is a prosecutor who needs to be removed, and I would hope the attorney general utilizes the same test of integrity as he did in the Stevens case," said U.S. District Judge Orlando Garcia, who ruled against Morris in Brown's case. "Though (the Brown case) is several years old, there is no statute of limitations on integrity."

Wonder if they can use the deprivation of rights under color of law statutes on this one? There is a right to the information during discovery, the prosecutors clearly violated that right, and since they did so jointly, they also conspired to do so. That covers the deprivation part and the conspiracy-to-commit part as well. Those are not civil law, either. That’s what the LA cops in the King case went to prison for.

With this prosecution, she didn’t need to donate money ... there’s a $2300 limit to financial donations .. think of this as an ‘in kind’ donation of the highest order.

It is probably that brenda Morris is her maiden/professional name and any donation(s) made would be thru her spouse and/or children. Wonder who she’s married to? That’s a pretty incestuous world they live in.
