Treason is specifically defined in the Constitution as ‘giving aid and comfort to the enemies of the U.S.’ The last time Congress declared war was in April of 1942. We have officially had no enemies since the end of WWII.

The Founders were careful with the treason charge because of their knowledge of English/British history, where a treason charge, and its horrible punishment could be levied against anyone who ‘discomforted’ the monarch.

The Rosenbergs were executed for espionage, not treason. The last person executed for treason in the U.S. was a guy in New Orleans who pulled down an American flag during the Civil War.

Not true. The first U.S. arrests of American Nazi spies working for Germnay was in 1938. Germany was already on the war path in Europe but formal declarations of war by France and Britain did not occur until a year later - 1939. We did not have to be at war with Germany nor even yet deliver aid to our allies in Europe to recogniza they were our allies and aiding Hitler was against our national interest.

Sure it is.

18 USC Ch. 115: TREASON, SEDITION, AND SUBVERSIVE ACTIVITIES

Nothing in §2381 requires the US to be engaged in a declared war with an enemy in order to qualify support for such enemy as treason.

Further, precedent setting broad applications of §2386 have been applied to individuals whose public activities are proven to be aligned with the interests or policies of hostile foreign powers.

Arguably, someone who is indicted for §2386 violations could be then prosecuted for §2381 violations.

Note that I am not assuming a conviction, just that an indictment could easily occur given the right circumstances and the political will to execute the prosecution.
