Judge dismisses California kids’ climate lawsuit. They plan to try again

After a federal judge dismissed a landmark climate lawsuit filed by 18 California children against the U.S. Environmental Protection Agency, the youth plaintiffs plan to amend and resubmit their allegations, their attorneys say.

The children — who have lost homes in wildfires, suffered health problems from breathing polluted air, missed weeks of education due to climate change-related school closures and been forced to ration tap water due to unprecedented droughts — sued the EPA for allegedly violating their constitutional rights by allowing pollution from burning fossil fuels to continue despite knowing the harm it poses to kids.

Judge Michael Fitzgerald of the U.S. District Court for the Central District of California this month ruled the plaintiffs lacked legal standing to bring the suit because they did not show how the remedies they sought — including a declaratory judgment that their constitutional rights have been violated — would mitigate those harms.

The lawsuit — Genesis B. vs. EPA, filed in December on behalf of plaintiffs ages 8 to 17 at the time — calls climate change “the single greatest driver of the health of every child born today.” It alleges that the EPA has intentionally allowed the United States to become one of the world’s biggest contributors to the crisis, despite issuing report after report detailing its harms, particularly to children.

When the EPA runs economic analyses to decide how much pollution to permit going forward, it assigns less value to the lives of children because they aren’t income earners, the plaintiffs’ attorneys say. The agency also applies discount rates that place less value on the future benefits of controlling pollution than the present ones, according to the attorneys, who say these practices discriminate against children.

The reason that doesn’t happen is because the laws are made by lawyers for lawyers. There are WAY too many lawyers. Anything that slows down, or in this case, stops lawsuits entirely, will never happen.

I can’t remember which science fiction novel this was in, but the calendar was divided between when there were lawyers and after they were all killed. Or what do you call three dead lawyers? A good start.

The founders would be shocked that people think a Federal bureaucracy should be able to run roughshod over the Constitution.

But don't worry, young people with heads full of mush. Biden has promised he will completely eliminate fossil fuels.

That’s right. I’m all for good stewardship of God’s Creation, but modern environmentalism is just a Trojan horse for Marxism, which has never worked anywhere and is in fact worse for the planet than capitalism.

The lawsuit was “landmark” only in the sense that it was purely a publicity stunt, though one given a lot of attention

It’s a preposterous suit, there is no proof of causation, the temperature data is manipulated by the constant movement of the thermometers and censoring of inconvenient data outliers, the fires are not caused by climate but by poor land management and freak occurrence and sometimes arson, fires happened all the time before anyone moved here, the growing trend theory is that CO2 isn’t as bad as they thought (doh! It’s what plants crave and the earth can absorb it) and maybe methane from cows is the real problem, how to explain great climate disasters throughout recorded history, why was Saudi Arabia once a lush jungle and now a dry desert, the people of the Mediterranean fought each other 4000+ years ago and migrated around over resources like rain scarcity, floods, fires, volcanos, on and on… the list of doubts about what the nature of the problem, “climate change” is such a vague and open term, who is responsible for which specific thing and does that thing actually cause harm.

You could I suppose sue an oil company for hiring drunk boat captain who crashed into rocks spoiling the waters you fished thus causing you economic harm. A train that spilled poison on your farmland. But suing over “climate change” is practically like trying to sue God. The climate is everything and it always has been changing. CO2 is still lower now after the Industrial Revolution that at times before. Oh and the north and south poles have switched a few times and will switch again. That could be a big problem for people in the future.

After filing the response the kids all got in their SUV’s to go home. Upon arriving at home they turned on their gas heater, cooked food on their gas stoves and watched Netflix on their electric TV’s and Internet routers.
