The Court did entertain the suit and determined that, based on the presentation of the Schindlers' attorney, that the case would have no merit.
The Schindlers were not well-served by these pro-bono barristers.

This is true. One idly wonders what might have happened if there were a lawyer of Johnny Cochrane's ability on the job...Gibbs basically lost the case for the Schindlers, I believe is the lawyerly consensus.
There might not have been much of a case, either, since the only de Novo point was on whether or not Terri received due process, and Gibbs, I believe, didn't really have anything to give to the contrary...or so I have heard lawyers here at FR discuss.

Well, Both Laura Ingraham, and David Boies saw it differnetly on the legal angle.
Boies (who has a vested interest in keepiong his mouth shut, since he practices), basically said the Judges clearly violated the law.
Probably true.
And it is fallacy to think that the WPPFers aren't also experiencing some degree of anger and/or grief.
Congress mandated nothing. They gave the Schindler's and their lawyers an opportunity to plead their case to the federal courts. The federal courts weren't under any obligation to take up the case or render an opinion. The legislation just basically left it up to the discretion of the federal courts.
The Schindler lawyers made the legal error of whining and complaining about Judge Greer, and the federal courts didn't want to hear it, so they threw the Schindler lawyers out on their collective ears.
The Schindler lawyers had been given 6 opportunities by the federal courts, to present new evidence, and they didn't have anything new. This is why the federal courts threw out every argument brought to them.
The courts didn't thumb their noses at Congress, the White House, Jeb Bush, or the American people. The Schindler lawyers made a mockery of the US Judicial system with their abject incompetance.
Due process review, that's it. Nothing more was required under the bill. If no due process violations are presented to, or found by, the reviewing court, end of case.

There was a hearing. From what I understand, the Schindlers' attorney presented nothing but objections to the manner in which Greer came to his conclusions. That's why Gibbs had to go back, a second time, to Whitmore to try to do what he should have done the first time.
