I've been looking for the criminal code for Aruba, which would define rape, as the Aruba government defines it. So far this is what I have found for the Netherlands:
http://www.ojp.usdoj.gov/bjs/pub/ascii/wfbcjnet.txt
It's a long article, here is the part about rape:
"Article 242 of the Criminal Code states that
a person is guilty of forcible rape if through the
use of force, threatened use of force or another
act of violence forces the sexual penetration of
the body of another. The punishment for forcible
rape is a maximum prison sentence of 12 years or a
fine of the fifth category (1,000,000 Dutch
guilders)."
"The Code of Criminal Procedure expresses
preference for fines over other forms of custodial
sanctions and requires an explanation be given by
the judge when a custodial sentence is imposed.
Fines, theoretically, can be handed down for any
offense, including murder. They are, however,
generally handed down for infractions, and many
crimes of a nonviolent, nonserious nature.
Incarceration is reserved for more serious
offenses such as murder and manslaughter, rape,
serious property and drug offenses. (Tak, 1993:
35)."
If this code for the Netherlands is the same as for Aruba, and if Urine is prosecuted and conviced for rape, the maximum time he could get in prison is 12 years. Or, maybe he papa could buy Urine's way out of prison for 1 million guilders. 12 years is not enough for rape.
