if the newer looking one is a copy,wouldn’t it have a dark mark where the tear is upper right?

Same document. Looks like someone just used photoshop to remove the background. It does not always come out clean when you select the piece to remove from the background. In other words, the black background one is a cropped version of the first one, not so neatly done.
My take is the top one is a photocopy of the second.

Look, this document is not three centuries old. It can be authenticated in two or three days once the appropriate enquiries are made.
It’s just a matter of determining whether or not the book and page exists and what’s on it.
This document looks genuine to me, but obviously it could be a forgery. I am in no position to know one way or another. The document itself is not available for scrutiny, but it might be subpoenad by the court. In any case the authentication needs to go to Kenya to determine what is in the book of birth records.

Sorry for my mistake - no coffee yet. The document was issued BY the Republic of Kenya after its establishment in 1963, so that's not a problem, per se. This document is quite interesting, but given its importance, I would imagine that its provenance would have to be established by the Commonwealth Office in London and/or the Government of Kenya.
The second appears to be exactly the same photograph. The shadows are the same, the interior detail the same. It has been photoshopped to remove the fabric backfground and whoever did that decided to enhance the aging by adding the ‘tear’ in upper edge, ‘ragged edges’, etc.
