A shoestring can be presented as evidence or naval lint. The question is what amount of weight will it carry. The court will not accept this photograph as a certified documentation of the existence of a Kenyan BC. However, it isn't being tendered as such either. It is being tendered as some proof that discovery of the matter overseas needs to be made. So she has asked the court to issue letters of Rogatory (basically requests to international courts to help do something) to see if UK Courts and or Kenyan Courts will issue orders to get documentation to authenticate or discredit this photograph.
If you read her motion you also find out she is headed to London this morning (this has been in the works a couple weeks) to go make personal requests of the back up evidence in the UK.
This is going to get pretty interesting. The only thing I wish we knew was th source of this photograph.
