Your point is taken but, a foreign national can choose (or could as we no longer have a draft) to return to their country of origin, to escape the draft, with no fear of prosecution.

An American citizen cannot.

IIRC, that was only legal permanent resident aliens. Not other types of legal foreign residents, not those on student visas for example.
