W NEEDS TO PARDON BORDER PATROL AGENTS

Hey, W, get out your pardon pen.

Right now.

Don’t wait for months or years, don’t leave a present when your term is about up. Do us some good today.

And pardon these two Border Patrol agents.

Specifically, the two Border Patrol agents who have been crucified by their own government in one of the most screwed-up, backward miscarriages of justice ever to come down the pike.

Here’s the story.

Ignacio Ramos and Jose Alonso Compean were on patrol along the Rio Grande in February of 2005 when they saw a van apparently driving across the river. Inside the van was a guy later identified as Osbaldo Aldrete-Davila. He is a Mexican national, and at that moment, being in the United States without permission, was an illegal alien.

The Border Patrol guys frown on illegals driving vans into the country. So they gave chase.

At a certain point they split up and went after Aldrete-Davila on foot. Agent Compean caught up to him and a struggle ensued in which Aldrete-Davila began stomping him. Agent Ramos came to the assistance of his partner and Aldrete-Davila broke away and ran back toward the Rio Grande.

Agent Ramos chased him to the river and, as the illegal neared it, ordered him to stop. Aldrete-Davila then turned toward the Border Patrolman and pulled something that looked like a gun and pointed at him.

So Agent Ramos pulled his gun and opened fire.

Aldrete-Davila turned and ran into and across the river, ultimately scurrying up the Mexican bank and hopping into a van, which quickly sped away.

The agents then returned to the van Aldrete-Davila had driven into the United States and discovered it was packed with some 800 pounds of marijuana.

Recap: Two agents of the Border Patrol intercepted and turned away an armed and violent illegal alien who had smuggled more than a million dollars worth of marijuana into the country.

And for that they’re facing 20 years in prison.

Seriously. They’ve been convicted of a slew of federal felonies, including violating the civil rights of Aldrete-Davila.

Because Agent Ramos shot him in the arse.

At least that’s what Aldrete-Davila’s mamasita said. See, he got home from trying to smuggle drugs into America and he had a second opening in his backside and this ticked his mother off and she was not going to let some nasty gringos perforate her boy so, after thinking about it a bit, she called the Department of Homeland Security.

In Washington, D.C. From wherever in Mexico it is that she lives.

She called the Department of Homeland Security to file a complaint with the inspector general about these two Border Patrol agents.

Which takes a lot of gall.

But she found on the other end of the phone someone as stupid as she was. And quicker than you can say “Reconquista” federal investigators were on the way to Mexico working on a ream job for Agent Ramos and Agent Compean. In fact, they offered the illegal alien drug smuggler, Osbaldo Aldrete-Davila, blanket immunity from criminal prosecution in the United States if he would testify against the Border Patrol agents.

That’s right.

He breaks into our country. The Border Patrol guys actually have the audacity to patrol the border. And the crook is getting a free ride so the cops can be crucified.

Amazingly, the drug smuggling illegal alien said he had no gun that night, and he claims he took a round in the back end out of pure maliciousness.

And a United States attorney believed it and ramrodded the Border Patrol agents to a criminal conviction.

Let me repeat this, in case you’ve forgotten: The guy who smuggled 800 pounds of drugs into our country and stomped a federal officer and pulled a gun on another, he gets immunity and was handheld by the “Justice” Department. Two brave men who put their lives on the line and broke up a smuggling convoy are going to jail for the rest of their lives.

Which gets us back to the pardon.

W, you’ve got to give these boys some help. Don’t make them go to sentencing, don’t make them sit in federal prison, don’t destroy their lives and break the hearts of their families. Pardon them. Right now. No delays, no diddle-fritzing, no hemming and hawing, put on your decider-in-chief hat and decide that these men got screwed.

And decide that the Border Patrol shouldn’t be sent the chilling message that if they protect America that the country will not only not be grateful, it will be vengeful. I guarantee, efforts to protect the border will blow away in the wind if these two defenders of America are sacrificed. If they go down for doing right, no other Border Patrol officer could ever by expected to do anything.

You’ve got to keep faith with the men who keep faith with us, Mr. President.

Pardon these men.

Give them back their careers.

And then give them a medal.

They’re not criminals, they’re heroes.

And if your government won’t stand behind them, the American people will.

You keep hanging on to this fairy tale that the agents picked up brass and lied in a report.

They were convicted for it. Who are you trying to fool?

United States Attorney Johnny Sutton announced that a federal jury in El Paso this afternoon convicted two U.S. Border Patrol agents on charges associated with a February 2005 shooting incident. The jury convicted Ignacio Ramos (a.k.a. “Nacho”) and Jose Alonso Compean with assault with serious bodily injury, assault with a deadly weapon, discharge of a firearm in relation to a crime of violence and a civil rights charge. Compean and Ramos were also convicted of four counts and two counts, respectively, of obstruction of justice. The jury acquitted both defendants of assault with intent to commit murder.

OK, the claim. Notice the aspect Aldrete-Davila presented to the agent: frontal.

So Agent Ramos pulled his gun and opened fire.

OK, here comes the punchline:

Sounds serious.

Because Agent Ramos shot him in the arse.

Uh-huh. Suspect is supposedly facing you, frontal aspect, and the entry wound is rear aspect. That's going to raise questions. BUT WAIT, THAT'S NOT ALL!

Bob, you also kind of neglected to mention the part about not telling their chain of command that they had opened fire until after this came to light, and destroyed evidence (by altering the shooting scene--they cleaned up the brass without documenting what had happened).

When you have serious questions about the veracity of the story, plus a failure to report the shooting up the chain of command until people started asking questions, plus removing evidence, you have criminal offenses. If Joe Civilian did this in his house, he would be looking at about 20 years in prison.

Like I said you disregard everything else that has been reported. Aldrete lied to DHS investigators stating that he was shot while entering the country. Ballistics have not matched the bullet to the Agents' service weapons. Their conviction was based on the false premise that the Border Patrol forbids persuits. Two of the jurors have already admitted to jury misconduct.

The government has a long history of being hostile to Border Patrol Agents for merely doing their job. If these guys are innocent then it's not out of character for the government to treat them as they have. It's par for the course in the Border Patrol. Considering all that has been reported, the antipathy the government has towards the Border Patrol I'm biased towards the agents you could at least admit your biased against them.

The scenerio Ramos gave for the shooting is entirely possible. You should pick up a Massad Ayoob article from time to time.

They got convicted by a jury in which two of the members admitted to jury misconduct. Given the venue of the trial it is quite possible to stock the entire jury with jurors that hate the Border Patrol. Personally, I found it odd that these guys are looking at twenty years when two corrupt Border Patrol Supervisors that worked for a major smuggling cartel get only five years. This case came to light through an agent's familiarity with the smugglers mother, another rather odd aspect that makes me think these agents got screwed.

Ayoob rules!

I believe it was one of his articles that shed light on how a turning suspect can catch one in the gluteus after an officer's mental decision to fire at what was, at that point, a frontal target.

Don't give these clowns any slack, Ajnin. That they uphold such a travesty of justice so vociferously tells their story.

I read the same article in Combat Handguns. He's awesome. These guys see a fault with the agents yet see none with the unethical prosecution. They are never on any of the threads detailing the crimes of illegals or the obstruction of agents doing their jobs and they wonder why they accused of supporting criminals.

You and your Union are trying to hide the crimes for which the agents were convicted.

Their conviction was based on the false premise that the Border Patrol forbids persuits.

From what I have read and heard, those agents were convicted under unethical circumstances. You keep railing about them picking brass and creating a false report yet you ignore the unethical prosectuion of this case. Two jurors have already admitted to jury misconduct. In this case you are either on the side of the agents or on the side of the drug smuggler. Despite the brass and report issue I'm on the side of the agents. You are on the side of the drug smuggler...obviously.
