Whatever his birth certificate says was recorded and filed over forty years ago. It is the legal, factual record of his birth. Finding out his grandmother filed it, which we have no reason to believe is the case, all hyperventilating aside, doesn't change that. It would get the birthers all excited again, but they still have no meaningful factual evidence to dispute the legal records of the state in question. Even assuming you could get this before a court, which I don't think you can, the court would be left with the official record of the state in question versus some people with a bunch of suspicions forty years after the fact. In our legal system, that's no contest.
I disagree. Obama’s refusal to release his original vital records screams out that he also believes it matters and is hiding something.
If what Obama is hiding is a report by grandma of a home birth, I believe that financial and investigative resources would be made available to intensify efforts to validate the Kenya BCs by folks who would be emboldened by the opening such a report would allow for a foreign birth.
All it would take is blood in the water. D’Onofrio’s quo warranto placing the burden of proof on Obama might just provide that blood.
The self-authenticating presumption of authenticity that the HI vital records and the COLB are entitled to under the FRE is not absolute, but can be challenged if credible authentication of a Kenya birth can be found.
Kenya is corrupt, but lots of folks have been protecting Obama, and as his popularity and power continue to fade, so will his protection. Individuals in Kenya or the US may yet come forward with testimony and documents that can be authenticated. You and I just don't know what would come out if a report of a home birth by grandma was revealed.
