He was asked and declined to answer. You obviously didn’t read the article, because you don’t understand the facts!
Dr. Onaka doesn’t have to answer reporters’ questions if he chooses not to, but he can be subpoenaed by a grand jury or a legislative committee or he can be deposed in a civil action and he can be forced to answer under pain of legal penalty.
I am certain that if any committee or sub-committee of the Hawaii legislature had asked Dr. Onaka to come testify about the authenticity of Obama’s COLB, he would have showed up and testified under oath.
When Dr. Onaka’s boss, Hawaii Department of Health Director Dr. Chiyome Fukino was asked to testify before the Hawaii Senate’s Committee on the Judiciary and Goverment Operations, she did in fact testify and said, in part: “For more than a year, the Department of Health has continued to receive approximately 50 e-mail inquiries a month seeking access to President Barack Obama’s birth certificate in spite of the fact that President Obama has posted a copy of the certificate on his former campaign website.

At any point in time Dr. Onaka could testify just like Dr. Fukino did. For example, the new Republican Chairman of the US House Representatives Committee on Oversight and Government Reform, Congressman Darrell Issa could invite Dr. Onaka to testify before the US Congress’s primary investigative committee.
