DNC lawyers would argue that his name really isn't on the ballot and argue for dismissal of any suit to keep him off it, and they would probably prevail.
Mebbie so, but the optics would screw him. Why make a fuss for something you've supposedly already produced? It would smell, and the public would scent it.
