Because in Sunahara v. HDOH the Court ruled that the Department of Health has discretion as to which version of a Vital Record they release to an applicant.
If the judge had been persuaded by Sunahara’s argument, the judge could have issued a court order for release of the original long form or a copy of it. Instead the judge granted HDOH’s motion to dismiss.
