This kid did nothing wrong...but he did do something out of the ordinary, and to them, that is suspicious. Based on that suspicion, they presumed wrong doing. Out of the ordinary is not "probable caus," to commit a crime, which is what the constitution says they have to have to search. So, they took his uncommon behavior, ie. simply asking them if giving his name and ID to them was "required," to be probable cause and from that point on, I promise you, they were going to search his car. But he did bait these police, and was attempting to push the limit...and their buttons without doing anything physical. As I see it, he did his thing, and the officers did theirs. He did not give them legal reason to search...but he did (IMHO) intentionally push to see what it would take and they used their own judgment and discretion after that.

HILARIOUS to hear them say, (while illuminating the video device), “it’s running.” Some LEOs are true idiots when they get badge-heavy.

One of the big problems is most people are not comfortable with confrontation. Police officers deal with confrontation multiple times a day. People can not stand Not answering an officer. They will use intimidation to get you to answer, but if you are not comfortable you will fold.
One of the best techniques I have ever heard was this girl picked up a card of the president of the ACLU and when pulled over she would not comply with the officers demands and would hand them the card and say, my dad is the president of the ACLU and told me to never answer your questions. I am more scared of him than I am of you... they let her go....

I’m curious what happened before the recording started. Was he stopped writhing for his turn, or was he doing something to catch the cops attention before he got to the checkpoint. I have seen people honk, yell or fidget at a DUI checkpoint get pulled aside immideatly.

Excellent video. What did they do with your phone/camera after they found it?
Reckless LEOs - and yet their work is inherently dangerous. Even so, they must follow the law.

Sad, really.

It was priceless to see the thug “peace officers” find the running video camera.

But I’m sure that the FR Stasi will be checking in to support our brave officers of the law as they figuratively burn the constitution in front of our faces, in order to make the country safe for, um, the Stasi and their overlords.

This video speaks volumes about the people who are in law enforcement today. Unfortunately a lot of these people were thugs and bullies as kids, give them a gun and a badge and you have amplified their flawed personalities. The sad thing is that lawsuits against police departments hurt the taxpayers. The officers in this video should not be in law enforcement because they do not respect the US constitution .

I think many miss the point..if you accept dui check points are legal then to check you is legal. . ( what sense done it make to have the cop stop your car if you do not do not have to get out and be checked)....my gripe is with check points in general.

So if the stop to check is legal..the check is legal.....that why I simple turn around at check points..I decline to be stopped and checked and not going through a checkpoint is not probably cause to be stopped.

If you accept the premises of being check at passing a point you accept what it for and what comes with it..got right alone with crossing a state border, going in a public building or court house security , going through customs or boarding a plane

someone said this was tennesse. does anyone know more specifically , I was think of sending a nice email to a state rep asking if they train these officers in correct procedure, seeing as they got so many things wrong.

law enforcement motto used to be; To protect and to serve. Now it's; to serve our public official masters to control, intimidate and abuse the citizen.

Little tin god syndrome is rampant in our law enforcement officials because there is never any personal price for their abusive unconstitutional actions. Suing the cop and their agency only results in more tax money being spent on trying to defending them. If you ever noticed, most of these kinds of cases get tossed by the judge and everybody but the victimized citizen is happy.

What is needed is a real time broadcast cellphone device that when activated goes right to a recording to your attorney’s computer. If and when he sees anything that is improper, he calls the police department, identifies himself, advises them that he has witnessed and video and audio recorded their officers violating the law at this checkpoint, and to notify them to suspend their activities immediately.

Well, this young fella caught these deputies half-stepping and they proceeded to violate his civil rights, shame on them.

I will show this video around my agency reaffirming that this is the complete opposite of department policy and what is legal.

I understand what this youngster is going through; I went through and illegal checkpoint last night conducted by a neighboring agency and I mean to have it shut down in the future, to include reporting it to the FBI if thats what it takes.
