Eleven GOP attorneys general say the Obama administration is breaking the law by repeatedly making changes to ObamaCare without going through Congress.
The attorneys general specifically criticize President Obama's executive action that allowed insurance companies to keep offering health plans that had been canceled for not meeting ObamaCare's more rigorous standards.
"We support allowing citizens to keep their health insurance coverage, but the only way to fix this problem-ridden law is to enact changes lawfully: through Congressional action,” the attorneys general wrote in a letter to Health and Human Services (HHS) Secretary Kathleen Sebelius. “The illegal actions by this administration must stop.” They say the healthcare fix was “flatly illegal under federal constitutional and statutory law.”
HHS did not respond to a request for comment.
West Virginia Attorney General Patrick Morrisey wrote the letter, which was signed by his counterparts in Alabama, Georgia, Idaho, Kansas, Louisiana, Michigan, Nebraska, Oklahoma, Texas and Virginia.
Signatories include Gregg Abbott of Texas — who’s running for governor this year — and Ken Cuccinelli of Virginia.
James D. “Buddy” Caldwell of Louisiana was previously a member of the Democratic Party, but switched to the GOP in 2011.
Republicans have often criticized the administration for making changes to the law after the fact. Other switches included the decision to delay the employer insurance mandate for a year, something many lawmakers said should have required a congressional vote.
Obama changed the law to allow insurance companies to allow canceled plans after coming under criticism when millions of people found out their plans were no longer being offered despite Obama's repeated promise that under ObamaCare, people would be able to keep their insurance plans if they liked them.
The change, the Republican attorney generals argue, exceeds precedents set by Supreme Court decisions.
The officials point to the 1985 Heckler v. Chaney case, in which the Supreme Court concluded that some enforcement actions of laws might be subject to judicial review first.
Security on the state and federal health insurance exchanges is another major issue the Republicans say they want the Obama administration to improve.
HHS continues to “ignore the widespread public outcry over the security of consumers’ private information” on exchanges,” they wrote, adding that they’re concerned about the administration’s decision to “not propose and implement rigorous privacy standards for outreach personnel.”
Hussein & Co are afraid of potential problems caused by the Republican controlled House. But they needn’t be. The gutless GOP will do whatever Democrats tell them to do. Repubs like the absolute power given politicians by ObamaCare just as much as Democrats!

Okay, so he’s committing illegal actions with all this tinkering and readjusting. I think we already know that. What I don’t know is what individual or entity is supposed to do something about it to make him stop. Heaven help us if that person is Eric Holder, if so nothing will happen. Holder and Obama are thick as thieves in law breaking or selective enforcement. What’s Preibus doing these days besides getting his suits tailored? Too bad Michael Steele turned out to be a racist RINO, with a noodle spine much of the time. Occasionally, you need somebody with a big voice to speak the heck up, not just passively weather the democrat rhetorical storms. I used to want Paul Ryan for such a role, but no, Ryan, while intellectually gifted (maybe) is too meek in public debates. Most the 47% only understand debate behavior, who won, who lost.

King Obama is the self acclaimed dictator of America and he has the support of the communists that control the Administration. This complaining means nothing. By the way, miss Romney yet? (I keep stressing this hoping that the GOP and the Republicans must be reminded how dissension can sometimes get us a spot in hell)
No Party will save us from this tyranny, it will have to be a popular uprising. Everywhere around me, I see signs of militias forming and fortifying. I would not be a bit surprised to see a faction of our Lib-beaten and sodomized military take the Sodomite in the Oral Office into custody. A military coup seems to be the only solution to this anarchy.

There is one taboo subject, never discussed here on Free Republic, that is very obliquely alluded to, but never spoken or actually articulated in any way, a rather Lincolnesque reference. Such an action has precipitated serious repercussions each time it has been applied, chances of success are extremely low, the consequences would bring untold grief to the parties involved, and with outcome uncertain in any event.
But it may be a last option of great desperation, should things head straight for the crapper.
