I was a prosecutor for 25 years. I don’t care WHAT the kid did before the cop confronted him. His hands were in the air. He was shot. He was murdered. My Office, based on the facts I see here, would have prosecuted the cop. I don’t care if it was Charles Manson who had his hands up. The cop committed a crime.
Be assured that if this type of police encounter is not prosecuted, the Police State will explode in scope and brutality.

How do we know his hands were in the air? From the testimony of the guy who helped him rob the store? The guy who said Brown was shot in the back, when there is no blood or bullet hole in the back of Brown’s shirt?

I’d hate to live where you were a prosecutor, you are deaf dumb and blind and rushing to judgment without a complete investigation and only biased witness statements. those of us with experience now eyewitness accounts are poor evidence. sure if he shot him with his hands up and no threat it would e homicide, but we don’t know that yet...do you remember Treyvon witness accounts?

You are 100% correct. All of this stuff about the robbery (and even about the initial contact with the cop) certainly makes Brown a less sympathetic person, but has absolutely nothing to do with whether the shooting was justified. If Brown was running away, if he was 30+ feet away, and certainly if his hands were up and he was surrendering, then there is no way to justify the shooting.

Should an officer shoot a fleeing suspect? The quoted policy indicates yes. There appears to be crappy eye witnesses, which isn't shocking. The whole turned around with the hands up thing I've discounted from the beginning. But that core question, should an officer shoot a fleeing suspect, is absolutely one that should be reviewed by a jury. It should not be left up to a police investigation or a FBI investigation.
And what really scares me is how many Freepers are all eager to jump up and down and call it a justified shooting. How long until the same reasoning is used to justify shooting protesters in front of an abortion clinic for failing to disperse? Or not dispersing fast enough.
Have you seen a video of his hands in the air? If not, then you’re working off the eye witness stories which are quickly falling apart. I’m not saying the cop went off on him but we need to wait for the autopsy report to know more about the shooting.
