The Birth Certificate became a dead issue the day in January 2009 that the House confirmed the 2008 presidential vote for Barack Obama.

Had the issue ever reached the SC, Roberts, based on his Obamacare explanation, would have sided with the status quo — ‘this what you voted for, so live with it’.

SCOTUS would have ruled that it lacks jurisdiction, that eligibility is decided by Congress, sitting in review of ballots from the Electoral College. It’s not up to SCOTUS to judge eligibility, that is a Congressional duty.
