Part of the fault lies with Congress (unconstitutionally) giving government bureaucrats the power to make rules with the weight of laws.
It’s not even unconstitutional, they literally can’t do it. It introduces a legal paradox where a governing authority takes legislative control over a body that no longer has the ability to legislate. They’ve literally nullified themselves.
American Federalism is dead.
