Sunday, I will continue my fight to end the illegal collection of American phone records. The Second Appeals court has ruled the NSA’s bulk collection of phone records illegal. We should not be debating modifying an illegal program. We should simply end this illegal program.

How will we defend ourselves if the Patriot Act expires? Well, perhaps we could just rely on the Constitution and demonstrate exactly how traditional judicial warrants can gather all the info we need—and how bulk collection really hasn’t worked.

We have all the tools we need to preserve both security and liberty. What we now need is a president with the will to do just that.

I have fought for several years now to end the invasive and illegal spying of the NSA on ordinary Americans. I am ready to debate how we fight terrorism without giving up our liberty.

Let me be clear: I acknowledge the need for a robust intelligence agency and for a vigilant national security. I believe we must fight terrorism, and I believe we must stand strong against our enemies.

Yet the expiration of the NSA’s sweeping, all-encompassing and ineffectual powers will not relinquish functions necessary for protecting national security but will instead do what we should have done all along—rely on the Constitution for these powers.

Of particular concern is allowing law enforcement to continue surveillance on suspected terrorists. This tool will still be available but through constitutionally sound warrants permitted by the Fourth Amendment. The only change is that the FBI must obtain a specific warrant for each device used by the suspect under surveillance through individualized warrants granted by the courts.

A federal court panel strikes down as illegal NSA bulk spying without a warrant and McConnell and Big Brother Stasis from both sides of the aisle want to extend the illegal provision. That doesn't make sense nor will it sit well with the hearts, minds and votes of the majority of Americans who, according to opinion polls, view government as the No.1 problem in the country. Are the Republicans so out of touch with the underpinnings of liberty that they would alienate much of their base on this crucial issue, and give the Dems plenty of ammunition? The Patriot Act hasn't caught one single terrorist in 14 years. Bravo, one senator has the guts to stand against warrantless searches and a Stasi govertment unbridled by law or Constitution.

Obama loves the Patriot Act so much that he signed two extensions of it without any changes. That alone argues this is a rotten law.

Try to read the full piece not just the excerpt. It's worth the time.

I can certainly support Rand a hundred percent in that endeavor.

BTW, with respect to the graphic: those are listed as “amendments” rather than “articles”.

Yes, I fully agree. That’s been said reflexively time again here. But surely you must agree this is the comoelling issue of this moment. Tomorrow is D-Day. Without liberty nothing matters.

They’ll still do it even after the law has passed. They spent a lot of money on 2 massive data centers in Utah and you think it will shut down by law? LOL

At least, give a guy a break when he’s right. Aristotle said man is by nature a political being. That’s nothing new. But the McConnell Republicans are being exceptionally stupid on this issue when you’ve got most Americans in polls saying they’re afraid of their government and that government is the #1 problem in the country. The Republicans want to pass a wholesale warrantless spying law federal judges ruled illegal. That’s not a very tenable or smart move for Republicans to undertake.

If every person in the country makes 10 phone calls a day that amounts to 3 billion calls. If (and that's a big if) the NSA really just collects the source and destination phone numbers, the time of the call and the duration it would take about 30 bytes of data per call, or 90 gigabytes per day. With commercial 4 terabyte drives they would need a new disk every month and a half. So what is the rest of the huge Utah data center for?

Right. Sure he will.

What about stopping illegal immigration hordes invading the country Rand?

What about stopping the surrender of the Constitutional treaty ratifications in the Senate Rand? Where were you to stop that?

Where are you to stop the EPA from controlling everything from our food to water to private property rights? Why so silent on those things Rand?

What about stopping the hundreds of other more direct assaults on our Rights by this government Rand?

Is it because bloviating about NSA snooping of phone records is much more palpable to your Libertarian pals than tackling actual tyranny Rand?

Looks like it to us.

Grandstanding to increase donations to his campaign is what it smells like.

Actually if you look at his history (speeches, interviews, senate actions, etc.), that is exactly the kind of thing he stands for. But even if he was just playing politics, where are the other GOP candidates? Who else is standing up for our rights? If they won’t support our rights now, what will they do if elected president?
