Illegal aliens are not criminally prosecuted and do not necessarily have Due Process. The can simply be deported, but being deported is not a criminal penalty.

An alien sneaking across America’s border violates the Immigration and Nationalization act, Section 237 a, 1. (b), and commits a crime.
Illegal aliens from Mexico, central America and who knows only where else not only receive due process, they receive food, water, medical treatment and a lot more consideration than Mexico shows to Guatemalans.

Entering the United States illegally is a crime. First offense is a misdemeanor after that it is a felony. Dido over staying or otherwise misusing a visa.
