Gov. Scott gets bill to block federal health-care overhaul

TALLAHASSEE, Florida — Gov. Rick Scott is getting a bill that would prohibit Floridians from being required to purchase health insurance.

The Republican-controlled Senate on Monday voted 30-7 for the measure (HB 1193) previously approved by the House.

It would put Florida in direct conflict with the federal health care overhaul that will require most people eventually to have insurance coverage.

Legal experts say federal laws trump state legislation.

Legal experts say federal laws trump state legislation.

They forget about Nullification. I think one or more states has already done that.

Amendment X to the US Constitution: “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.”

What part of the US Constitution prohibits a state from passing a law that says people in the state do not have to purchase health insurance?

Actually none, nullification is the remedy when the federal government oversteps it's bounds as it has clearly done here. Right now the Federal government can tell you what kind of toothpaste you have to use.

Also, judicial history is against ObamaCare since the states have been told over and over that health insurance can't pool across the states. Whereas ObamaCare does.
