Just curious, who has the burden of proof ? As we have seen in politics a good person can be have his character assassinated and a gangster can get elected into public office. Corporate politics can be just as ruthless. How would you protect yourself?

In my past, when I had to create a record of notice of poor performance I would have the employee sign-off on the conversation or I would send an e-mail referencing the conversation. Either one creates a paper trail.
The employee could always dispute the notice but the fact is that most employees never realize that the process to get rid of them has been started and never bother to respond.
