Furor Over NYPD Choking and Beating Staten Island Man To Death [Video]

A 400-pound Staten Island dad of six, suffering for asthma, died Thursday after a cop put him in a chokehold and other officers appeared to slam his head against the sidewalk, according to a video of the incident published on The Daily News website.

“I can’t breathe! I can’t breathe!” Eric Garner, 43, is heard screaming after at least five NYPD officers took him down in front of a Tompkinsville beauty supply store when he resisted an arrest.

Within moments Garner stopped struggling and appeared to be unconscious as police called paramedics to the scene.

The Staten Island resident was sitting in front of Bay Beauty on Bay St. and Victory Blvd. just before 5 p.m. when two plainclothes cops began questioning him about selling untaxed cigarettes, the Daily News reported. he started yelling at the cops that he was innocent.

A guy, who shot the video below, tried to intervene, telling the cops his friend had just broken up a fight between three men and had not been selling cigarettes. But when backup uniformed officers arrived, the cops moved in to cuff Garner, the video shows.

“Don’t touch me, please,” he said. When Garner refused orders to put his hands behind his back, one of the plainclothes cops got behind him and put him in a chokehold, the footage shows.

Three uniformed officers joined in on the arrest, knocking him to the ground. He screamed, “I can’t breathe, I can’t breathe! Get off of me, get off of me!” several times before he went silent.

In a statement on Friday, NYC Council Speaker Melissa Mark-Viverito called for a “full, transparent and thorough investigation into the incident which led to the death of Eric Garner. New Yorkers expect and deserve to be safe and those protections must include those who are in the custody of NYPD.”

Mayor Bill de Blasio said in a statement, “On behalf of all New Yorkers, I extend my deepest condolences to the family of Mr. Garner, who died yesterday afternoon while being placed in police custody. We have a responsibility to keep every New Yorker safe, and that includes when individuals are in custody of the NYPD. That is a responsibility that Police Commissioner Bratton and I take very seriously. We are harnessing all resources available to the City to ensure a full and thorough investigation of the circumstances of this tragic incident. The NYPD’s Internal Affairs Bureau is working closely with the Office of the Richmond County District Attorney, which is leading this investigation.”

The mayor will have a press availability at City Hall this afternoon, before he takes off for vacation in Italy.

The guy was obviously arguing his case and the two cops were just standing there, letting him blow off steam ... then the blue tornado

So ... what was the reason the guy had to state his case his case in the first place ?

Well, unless the cops had a signed affidavit, a complaint, and a warrant for his arrest... it is called kidnapping which led to the MURDER of this 43 y/o man.

Read the law, it is amazing what the *"private contractors" get away with these days.

Are you implying he died on the sidewalk due to being overweight? Is this what you're suggesting?

This black man was brutally murdered.

He appeared to be walking and breathing just fine prior to being choked off and choked to death here on the streets of America.

He even told them he was dying, repeatedly gasping the words he was unable to breath. And you comment on his weight? Implying it was his fault?

Are you so GD pro-government you'll defend them regardless?

I was going to ping the entire forum to this thread so they can view the video and your comments wideawake...

In one of them, explain why it is an anomaly that a 400 lb man should have a heart attack.

Perhaps it is, and perhaps he should get special privileges.

After all, if I refused to cooperate with an arrest, I know that I would be made to cooperate one way or another.

But I'm only half his weight, so maybe the law should only apply to me and not to him.

Don’t know what the cops knew or what they saw him do. Was he in the gang connected to the cop killer in Jersey City, a few miles away? A cop was shot to death by the Bloods, and they made a shrine to his killer. I am sure all police have quick triggers right now, and that is to be expected.

If you don’t want to be dragged to the ground, then don’t resist arrest.

If the cops say turn around, you turn around. I don’t want to live in a society where people do not have to listen to the police. I also don’t want to be abused by police, but I did not see that here. He resisted and invited the violence, which was restrained. Frankly for his size, this was not abusive but warranted force. No blows were delivered, and the choke hold was not prolonged.

This amount of force does not kill a human being, this person had other health issues.

If it turns out the man was being wrongfully harassed by police when then that changes the situation.

His ethnicity seems to be an extremely important factor to you.

Why is that, exactly?

His death could just as easily have occurred if he had taken one too many flights of stairs, or if he had slipped and fallen crossing the street - he had a heart attack. He was not shot, or stabbed, or poisoned.

Had he been a healthy 200 pounder and had been forcibly made to comply with the arrest, he would be alive and complaining right now.

If he had simply acknowledged that he was being arrested and done what a rational person would do: ask what the charges are, request a lawyer, and tell a friend or family member to call a lawyer, he would be alive.

But he decided to resist arrest, even though he was well aware that he would still be taken into custody one way or another.

He didn't just arrive here from Mars. This was not his first rodeo.
