Colorado Rejects Jailing Illegals for ICE

Colorado is now the first state in the union whose complete roster of county jailers has individually rejected retainer requests from Immigration and Customs Enforcement. Due to pressure brought by the ACLU, no more immigrants will be held in the jails until federal agents make a decision as to whether the immigrants will be jailed for possible immigration violations.

Mark Silverstein, legal director for the American Civil Liberties Union of Colorado, cheered, "All sheriffs have agreed that they don't have the ability to deprive people of liberty, even for a few days, because they are suspected of being here illegally.”

The pressure brought to bear by the ACLU had been building for six months; state law precludes Colorado sheriffs from holding suspected illegal immigrants in jail any longer than they would be if released on other charges.

No more immigrants will be held in the jails because the stoner state needs drug mules to keep the weed supply up for the tax money they receive from it.

Despite the ACLU’s backing of this, and their primary intent being to aide illegals, there’s a silver lining that I don’t think they intended.

While the downside is that some illegals are getting a get out of jail free pass—and I do have a problem with that—I have a bigger problem with the feds treating local sheriffs as their personal hired hands. I like the autonomy the locals exercised here. This precedent is going to come in handy down the line, many times over, imho.

This is not just about ICE. If ICE can order local LEO around and demand they do this or don’t do that, so can Homeland Security, ATF, the IRS, EPA or, given the way things are going, even the Oval Office. The precedent these sheriffs set is, imho, far more valuable to the principles of liberty than this one issue—frustrating as it may be.

I agree. What SHOULD be happening is the county sheriffs, on their own, being able to check immigration status and charge them and hold them to turn over to ICE. However, that is never going to happen.

Actually, the sheriffs did choose to uphold the law. They did not pick and choose. It was the federal government that was trying to get them to do the wink and nod thing.

If ICE can require local law enforcement to detain someone contrary to law, then so can any other Federal agency, at their whim. Just a phone and a pen. No thanks. There's enough of that going around.

Exactly. Local law enforcement is denied that authority because the federal gov’t has neither desire nor intent to enforce existing deportation laws.

Illegals are a protected class. Laws don’t apply to them.

They operate outside the framework of society.

Thanks.

The initial reactions are understandable, though, given the way it was reported. Local sheriffs cave to ACLU. Some days, I would have left the story in disgust, on first glimpse of ACLU claiming victory (and been right 95% of the time)—in the same way I flip channels when Karl Rove comes on. I suppose he accidentally says or does something once in awhile that’s an inadvertent net gain for the country, too.
