Why would they charge him after he was dead?

If that is the reason he committed suicide then he was one seriously weak-minded person.

They had pretty much better be EXTREMELY certain the person stole from them.

“The walk of shame is a Target policy to purposely cause shame, embarrassment and emotional distress to any Target employee who is suspected of stealing from Target,” the suit states. “The policy consists of employees being arrested and paraded in handcuffs through the Target store in full view of co-workers and customers.”

WTF?

Why not sue Marriott for letting him on the roof as well. Peg out the frivolity meter.

Well a few guesses.
To actually put handcuffs on him and take him in for interrogation makes me think they had solid proof that he was stealing.
Apparently just having him not show up for work anymore because he was arrested for stealing wasn’t deterrent enough so Target seems to have opted for an arrest without charges for the sake of deterrence.
I say this because it seems patently illegal to use the police to bully your employees in case they are stealing.
So the wording “suspected” of stealing is used instead of “caught stealing” because Target let the matter drop in exchange for humiliation.

So who the heck shops at TArget anymore anyway?

If those centrist and on the right simply stopped going there, this discussion would be pretty much moot.

I don’t shop there anymore and, frankly, this doesn’t surprise me a bit.

While I have no use for thieves, to deliberately detain, handcuff and walk through their place of employment to interrogation by LE then RELEASE AND NOT CHARGE WITH ANY CRIME is taking things to far or at least in the wrong order. All this was was done on mere suspicion apparently with little to no evidence.

Mr. Gentles mother I believe has a case with a personal injury lawyer. In light of Target releasing a statement expressing sympathy for the loss of her son they have opened up an avenue for a lawyer to show they felt culpable for for his death. This could be a major expensive blunder for Target.

” ... he was later released and never charged with any crime.”

This is the problem with Target’s policy. There has to be a better way to confront an employee who is suspected to be a thief but where probable cause for arrest has not yet been reached.

a) The message was sent loud and clear to other employees: Don't steal.

b) The kid quit his job.

c) Target refused to press charges, meaning the kid had no record.

Win-win for everyone. No reason to kill yourself.

and, at the direction of two members of store management, was handcuffed and led before other store employees

Something doesn't sound right. He wasn't handcuffed at the direction of the store manager. He was handcuffed by police who had probable cause to cuff him.

I had a 1SG in Germany that would have a Company formation for a soldier Chaptered (thrown out, usually 5 or 14). He or she would load up in the back of a Deuce and a Half with their duffel bag, one mandatory lap around the Quad and off to Frankfurt Rhein/Mein.

1SG (Uncle) Billy R Herring would then ask if there were any other low life pieces of shit that didn't want to soldier. No? Then get to work - Dis-Missed!

I loved that man.

That’s horrible treatment .. and a good reason for me to continue never shopping at Target.

There’s a remedy .. you report them to the police, and then you fire them.

Case closed.

“However, the suit alleges that Graham Gentles’ involvement in a “verbal altercation” with another Target worker at a bar outside of work hours several months before the handcuffing incident may have prompted management to subject him to the “walk of shame.”

So it seems he and another target employee had a fight in a bar and he turned on this kid. Target better hope they have more evidence than a potentially false accusation from another employee.

He was apparently “autism syndrome” or Aspergers. He also served in the US Army, according to his obituary photo album.

I believe it is a good lawsuit, if it can be showed Target uses this method to discourage stealing, by potentially ruining the reputation of an innocent employee.
