The Texas Republican, who on Monday formally announced his 2016 presidential bid, was born in Canada in 1970, sparking chatter in recent years that he did not meet the constitutional requirement that to be eligible to run for the presidency, one must be a natural-born U.S. citizen.
Cruz, who was born to an American mother and a Cuban father who immigrated to the U.S. and later became a naturalized citizen, has repeatedly maintained that he, as the child of a woman who was a U.S. citizen from Delaware, is a natural-born citizen.
Critics have claimed that his being born in Canada indicates hes not a natural-born citizen.
In fact, the U.S. Constitution simply says that no person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President.
While a fringe minority of scholars claim that a natural-born citizen must have been born on U.S. soil, the prevailing legal interpretation is that natural-born simply means being born with U.S. citizen (as opposed to acquiring it later via naturalization).
A detailed memo produced by the Congressional Research Service in 2009 to help quell birthers claiming that President Obama hadnt been eligible for the presidency largely, if not altogether, put the issue to rest.
The weight of scholarly legal and historical opinion appears to support the notion that 'natural born Citizen' means one who is entitled under the Constitution or laws of the United States to U.S. citizenship 'at birth' or 'by birth,' including any child born 'in' the United States, the children of United States citizens born abroad, and those born abroad of one citizen parents who has met U.S. residency requirements," the agency said in the memo.

There are three main sources of law in our republic; the Constitution, the legislative process and court precedent. Before Obama, I would not have accepted Cruz as eligible. The courts have been given ample opportunity to invalidate Obama based on his birth details. If the courts have ruled, either proactively or by default that Obama is legitimate then Cruz certainly is.
One thing I have learned in the study of law is that courts are inconsistent. Each case stands on its own. There is sufficient precedent to support any outcome the judges prefer.

It is not “fringe” to suggest a logical, consistent and strict standard. BOTH parents, not one. Jurisdictional issues over the child linger on unresolved.

I remain disgusted with the self-serving sacrifice of clear principle and clear intent that guided the genius of our Framers. It has only seen since the fraud showed up that there has been the kind of garbled, inconsistent, and destructive thinking about what defines eligibility and what defines natural born. Not sure if the self lathing author remembers but it was Obama himself who said he was born in Kenya. DO they really think his book jacket announcing that he was born in Kenya didn’t raise a few eyebrows?

There’s the political bandwagon of second and third generation Americans, shouting from the coasts, pining for the old country, its religion, and refusing to assimilate. Oh, those aren’t musical instruments, and that bunch is ready to fire on any whole Americans who disagree with them.
There is native born citizen or a citizen born on US soil.
There is a citizen born with a birthright or a person born with the right to claim citizenship inherited from one of their parents or both parents.
And then there is a natural born citizen or a citizen who is free of foreign state obligations.
Or the brief bio of the author, which he had his peeps dismiss as inaccurate and un-reviewed by Obama.
Obama's a bald-faced liar and a fraud. I still don't fathom how he manages to bamboozle and charm so many people. At least the Wizard of Oz was a charming BS artist. This one, all he has is the gift of angry gab.

I believe that Pandora's box was cracked by the left constantly dismissing "Birther" claims of Obama's legitimacy. If they attack Cruz on the same grounds, they're collectively shooting themselves in the foot, because it will bring back all of the questions about Obama, and I believe it will show that he was not qualified after all.

Finally Canada has some skin in the game! I am reminded of the saying when the Blue Jays won the world series in 1992 and 93. Our Americans beat their Americans. Not that Ted Turner was that American for the 92 series. One of the best laughs was when someone at the Toronto Sun dredged up a photo of Jane Fonda wearing a Blue Jay jersey (some years before marrying Ted) and plastering it on the front page.
The location of Birth is not as relevant as fathers national ties... native born and natural born are not interchangeable. To this day Obama is not a natural born citizen as his father is and always was a foreign national..
But we’ve dumbed people down to the point that facts don’t matter.
Everything you say is true as is this. A court precedent has been set and if the courts rule that white is black and up is down, for legal purposes, those are true statements.
It sucks but that’s the law. Just like legalized murder in Row v Wade.
