No, it’s not BS. As Sec of State, she IS the classifying authority. But she may delegate that responsibility. In the end, the buck stops with her.

(a) Authority for original classification of information as Top Secret may be exercised by the Secretary and those officials delegated this authority in writing by the Secretary. Such authority has been delegated to the Deputy Secretaries, the Under Secretaries, the Counselor, Assistant Secretaries and equivalents; Chiefs of Mission and U.S. representatives to international organizations; and certain other officers within the Department and at posts abroad.
(b) Authority for original classification of information as Secret or Confidential may be exercised only by the Secretary, the Senior Agency Official, and those officials delegated this authority in writing by the Secretary or the Senior Agency Official. Such authority has been delegated to Deputy Assistant Secretaries, Principal Officers at consulates general and consulates abroad, and certain other officers within the Department and at posts abroad. In the absence of the Secret or Confidential classification authority, the person designated to act for that official may exercise that authority.

My DH’s whole career has been working for contractors for defense, pretty much all Confidential and T.S. projects. He said there’s NFW PIAPS wasn’t able to identify the emails for what they were. New hires out right out of grad school are able to identify T.S. docs. She’s so screwed. Sadly, she’ll never pay the price; she’ll be protected....

Well, regardless of the classification, the SOS should know what data should be protected and what should not. I would think almost anyone would have that level of discernment.

Thanks for the correction. I still don’t believe she was all on her own though. The security administrator must have had some input. I had a secret, never ever saw a secret document, but was pencil whipped quarterly on all the details. As I said the thumb drive is the smoking gun, highly illegal.

Not sure that SHE is the classifying authority if the documents originated on another Department such as the DoD. In that case, the SoD would be the classifying authority and Hilllary could not skate on that technicality.

I know it often seems that way, because the security manager often writes the security classification guide and is the primary POC, but in fact it is the SES/GO/ or political appointee that is USUALLY the actual classification authority (there are rare exceptions, admittedly). Been there done that, and they can change their mind, or classify/not classify as they see fit and no one can say a thing (except other agency SCAs that see things differently and start a pissing contest). If she received information form diplomatic contacts that we might think should have been classified, it is in her purview and she will skate. If, as other sources have reported, she was getting docs from the NSA and others that was properly marked when received and then cutting and pasting and sending it out through her email account without marking it, whichever one of her staffers did this will get written up. I've never seen anyone above the one star/tier one level who does this stuff themselves, they have a staff, so I seriously doubt she will be personally held accountable, if anything it will be her staff.
